The Commitment indicates a proposed insured: GWSA Land Development, LLC, <br />a Minnesota limited liability company. If the property is to be conveyed from <br />Sycamore Investment Partners, LLC, to GWSA Land Development, LLC prior to <br />the recording of the Plat, I require review of the documents of conveyance from <br />Sycamore Investment Partners, LLC to GWSA Land Development, LLC, a <br />certificate of good standing for GWSA Land Development, LLC, and evidence that <br />the person signing on behalf of the entity is authorized to execute the Plat on the <br />entity’s behalf. I require review of these instruments prior to the City’s release of <br />the Plat for recording. <br /> <br />c. The Commitment indicates that there is no mortgage on the Property. I require <br />verification that no mortgages will be recorded against the Property prior to the <br />recording of the Plat. <br /> <br />2. Title Commitment Exceptions. The Commitment is subject to the following exceptions: <br />a. Terms and conditions of Memorandum of Understanding between the City of Lake <br />Elmo and GWSA Land Development, LLC, filed November 15, 2017, as Document <br />No. 4135230. The Memorandum of Understanding memorialized the City’s and <br />GWSA Land Development, LLC’s understanding that a certain Outlot D of the <br />Northport subdivision would be credited towards park dedication for the GWSA <br />subdivision. No further action is required. <br />b. Terms and conditions of Drainage and Utility Easement, in favor of City of Lake <br />Elmo, as created in document filed September 17, 2018, as Document No. 4168670. <br />The easement must be shown on the Plat and marked with a reference number. <br />The City should review the location of this easement once it has been added to <br />the Plat to determine if it needs to be vacated. <br />c. Terms and conditions of Stormwater Management Facility Maintenance <br />Agreement, filed May 15, 2024, as Document No. 443987. The Agreement is <br />between the fee owner in favor of the Valley Branch Watershed District (VBWD). <br />The Agreement required the fee owner to grant the VBWD certain easements for <br />all floodplains and for the lands used for stormwater management facilities. No <br />other action is required. <br />d. Terms and conditions of Development Agreement for North Star, filed May 15, <br />2024, as Document No. 4436989. No further action is required. <br />e. Terms and conditions of Stormwater Reuse Irrigation System Maintenance and <br />License Agreement, filed May 15, 2024, as Document No. 4436991. No further <br />action is required. <br />f. Terms and conditions of Declaration of Covenants, Conditions, Restrictions and <br />Easements for North Star, filed November 15, 2024, as Document No. 4454650 <br />(Additional Property).
