Planning Commission <br />•The Planning Commission has recommended approval of the request with the recommended findings <br />and condition with the criteria that the developer remove the flexibility for the bituminous trail and <br />replace it with the standard traditional sidewalk and that the developer call out the exact lots that <br />would require the 40% impervious surface maximum. (Vote 6-0). <br />•Staff finds the Planning Commission recommendation on impervious surface may create enforcement <br />issues down the road as the developer is not the builder so they may not be able to correctly identify <br />the exact impervious surface of lots without knowing the home designs at this stage in development. <br />This request may also generate confusion and complaints if there are different standards on the same <br />lot type for residents as they add improvements in the future (patio, pool, etc.). <br />•The impervious standard was amended in 2024 to be considered per lot as opposed to the entire <br />development. The proposed development meets the previous standard of 25% for the entire <br />development. The standard was changed because reviewing permits was difficult to calculate without <br />a per lot standard. <br />•Staff finds the Planning Commission recommendation to require concrete sidewalks will be consistent <br />with other developments in the city. The developer is proposing adequate bituminous trail length and <br />connectivity. A 6’ wide trail will also reduce the overall site impervious surface.
