For several years, <br />Public Works staff have accessed the ice rink area within Lions Park through the property located at 11320 <br />Upper 33rd St. N. to perform winter maintenance activities, including snow removal and flooding of the ice <br />rink. The City was recently informed that the property owner does not wish City staff to continue accessing the <br />park through his property without a formal agreement in place. As a result, the city’s attorney has worked <br />with the property owner to develop an agreement that would allow continued access to the ice rink area for <br />maintenance and operational purposes while addressing the property owner's concerns. <br />ISSUE BEFORE COUNCIL: <br />Whether the City Council should approve a license agreement with the property owner to provide City staff <br />access through private property for snow removal, ice rink maintenance, and other operational activities <br />associated with Lions Park. <br />PROPOSAL DETAILS/ANALYSIS: <br />The proposed agreement would provide the City with permission to access Lions Park through the private <br />property located at 11320 Upper 33rd St. N. for the purpose of maintaining and operating the ice rink area if <br />needed. Public Works staff have historically used this access route to perform snow removal operations and <br />flood the ice rink during the winter season. The property owner has informed the City that continued access <br />through the property will require a formal agreement. The proposed license agreement establishes the terms <br />and conditions under which City staff may access the property and clarifies the rights and responsibilities of <br />both parties.
