City of Lake Elmo <br />Washington County, Minnesota <br />Resolution 2002 -108 <br />Whereas, the City Council of the City of Lake Elmo, following multiple local Public <br />Hearings, and a unanimous recommendation of the Planning Commission adopted a 2000 <br />2020 Comprehensive Plan, as required by State Statute; and, <br />Whereas, said Plan adoption is subject to the review and comment of the <br />Metropolitan Council; and, <br />Whereas, the Metropolitan Council adopted Resolution 2002 -30 on September 11, <br />2002 that finds the Lake Elmo Comprehensive Plan "substantially departs from and has a <br />substantial impact on Metropolitan System Plans and therefore must be modified"; and, <br />Whereas, the Plan modifications mandated by Metropolitan Council Resolution. <br />2002 -30 would result in a fixture development strategy for the City that is significantly <br />different than that which would result from the Comprehensive Plan developed by Lake <br />Elmo, and adopted by Lake Elmo's elected City Council; and, <br />Whereas, those significant differences between the Metropolitan Council - mandated <br />Plan modifications and the adopted Lake Elmo Comprehensive Plan go to the very fabric of <br />future Lake Elmo community character, and represents an effort by the Metropolitan <br />Council to overturn the decisions of local elected officials regarding that community <br />character; and, <br />Whereas, the Metropolitan Council in its decision regarding the Lake Elmo <br />Comprehensive Plan has extended its reach and authority regarding Regional Systems well <br />beyond the bounds intended by the Minnesota Legislature, and; <br />Whereas, should the decision of the Metropolitan Council regarding the Lake Elmo <br />Comprehensive Plan stand, local decisions by elected officials regarding development, land <br />use, and zoning policy that may not correspond with Metropolitan Council policy, whether <br />said Policy directly relates to Regional Systems protection or not, will be subject to <br />Metropolitan Council veto, and; <br />
