1. Based on the foregoing, the Applicant's request for a PUD Amendment hereby approved, <br />subject to the following: <br />a. Easements shall be provided up to the 100 -year high water level for all storm water <br />facilities. These easements shall be shown on the utility and grading plans. <br />b. The applicant shall enter into a maintenance agreement with the City of Lake Elmo <br />related to the construction (and/or expansion) of the storm water facilities on the site. <br />The legal descriptions for all storm water facilities (including access) must be added to <br />the maintenance agreement, and this agreement must be approved and executed by the <br />City prior to the commencement of any work authorized as part of the PUD amendment. <br />c. The applicant shall provide written approval from Xcel Energy to allow the expansion of <br />the parking lot underneath an existing power line easement. <br />d. The applicant shall submit a revised landscaping plan depicting the landscaping materials <br />to the salvaged during construction and replanted on other portions of the site. The plan <br />shall provide for additional plantings along the northern property line to provide year- <br />round screening from the property to the north. The -updated landscape plan shall be <br />reviewed and approved by the Planning Director prior to the commencement of any work <br />authorized as part of the PUD amendment. <br />Passed and duly adopted this 21" day of June 2011 by the City Council of the City of Lake Elmo, <br />Minnesota. ) /I <br />Johnston, Mayor <br />Bruce Messelt, Cit Administrator <br />
