•�,MITI NIIA <br />Ig'�1.Y�771 ► ► 1 <br />RESOL UTION APPROVING A THE LAKEWOOD CROSSING PRELIMINARY PLAT AND <br />FINAL PLAT, AND APPROVING A CONDITIONAL USE PERMIT FOR A GASOLINE <br />STA'T'ION IN STAGE I OF THE I--94 CORRIDOR PLANNING AREA <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, CM Properties 94 LP, 3470 Washington Drive, Suite 102, Eagan, <br />MN and Kwik Trip, Inc., PO Box 2107, La Crosse, WI, have submitted an application to the City <br />of Lake Elmo (City) for a Preliminary Plat and Final Plat to be called Lakewood Crossing on an <br />approximately 6 acre in Stage I of the 1-94 Corridor Planning Area (PID: 34.029.21.44.0007), a <br />copy of which is on file in the City of Lake Elmo Planning and Zoning Department; and <br />WHEREAS, CM Properties 94 LP, 3470 Washington Drive, Suite 102, Eagan, <br />MN and 1{wik Trip, Inc., PO Box 2107, La Crosse, WI, have submitted an application to the City <br />of Lake Elmo (City) for a Conditional Use Permit to construct a gasoline station and car wash; <br />and <br />WHEREAS, notice has been published, mailed and posted pursuant to the Lake Elmo <br />Zoning Ordinance, Section 154.102; and <br />WHEREAS, the Lake Elmo Planning Commission held public hearing on July 14, 2014 <br />to consider the Preliminary Plat, Final Plat and Conditional Use Permit request; and <br />WHEREAS, the Lake Elmo Planning Commission adopted a motion recommending <br />approval of the Preliminary Plat, Final Plat and Conditional Use Permit subject to 8 conditions of <br />approval; and <br />WHEREAS, the Lake Elmo Planning Commission has submitted its report and <br />recommendation concerning the Preliminary Plat, Final Plat and Conditional Use Permit as part <br />of a memorandum to the City Council from City Planner Nick Johnson for the July 22, 2014 <br />Council Meeting; and <br />WHEREAS, the City Council reviewed the application at its meeting held on July 22, <br />2014 and made the following findings of fact: <br />1) That the Lakewood Crossing preliminary and final plat are consistent with the Lake Elmo <br />Comprehensive Plan and the Future Land Use Map for this area. <br />2) That the Lakewood Crossing preliminary and final plat comply with the City's C - <br />Commercial zoning district. <br />3) That the Lakewood Crossing preliminary and final plat comply with the City's subdivision <br />ordinance. <br />Resolution 2014-61 <br />
