MINUTES APPROVED AS AMENDED JULY 5, 2011 <br />LAKE ELMO CITY COUNCIL MINUTES JUNE 21, 2011 2 <br />REGULAR AGENDA: <br /> <br />Approve Payment of Disbursements in the Amount of $169,227.27 <br /> <br />Council Member Pearson questioned City reimbursement fee for TKDA Whistling <br />Valley claim. City Attorney Snyder stated the costs are highly likely to be covered by the <br />performance bond. <br /> <br />MOTION: Council Member Smith moved to approve Payment of Disbursements and <br />Payroll in the amount of $169,227.27. Council Member Pearson seconded the motion. <br />The motion passed 4-0. <br /> <br />Letter of Support for Amendment to Minnesota Rules for MPCA Landfill Siting <br />Requirements <br /> <br />Council Member Pearson expressed a lack of foundation regarding the City endorsing the <br />proposed amendments to the MPCA landfill siting requirements. <br /> <br />Mayor Johnston stated the City has spent several years supporting the proposed <br />alternative. <br /> <br />MOTION: Council Member Smith moved to approve the proposed Letter of Support for <br />proposed amendments to the Minnesota Rules, Chapter 7001 and 7035 delineating <br />additional siting requirements for MPCA approval of certain landfills, as presented. <br />Mayor Johnston seconded the motion. Motion passed 3-0; Council Member Pearson <br />abstained. <br /> <br />Resolution Affirming Participation in the Office of the State Auditor’s Voluntary 2011 <br />Performance Measurement Program <br /> <br />At the request of Council Member Pearson, City Administrator Messelt presented to the <br />City Council consideration of the City’s participation in the voluntary 2011 Performance <br />Measurement Program. The 2010 State Legislature enacted the funded mandate to <br />establish a standard set of performance measures for cities. It is a State funded mandate <br />for the first two years. <br /> <br />Discussion ensued regarding the efficacy of participating in the Performance <br />Measurement Program, even though it is currently voluntary and funded, at least partially <br />by the State. The City Council discussed the current benefits of participation but also <br />acknowledged the need to evaluate this program annually, especially if it evolves into <br />another "unfunded mandate" by the State. <br /> <br />MOTION: Mayor Johnston moved to approve Resolution No. 2011-022, affirming the <br />City’s participation in the Office of the State Auditor’s Voluntary 2011 Performance <br />Measurement Program. Council Member Park seconded the motion. Motion passed 3-1; <br />Council Member Pearson voting no.
