LAKE ELMO CITY COUNCIL MINUTES JUNE 2, 2009 3 <br />Consider a revised plan for a variance application from Mr. & Mrs. Hugec, 2931 Jonquil <br />Trail N., Resolution No. 2009-022 <br /> <br />Kelli Matzek, City Planner, reported the City Council is being asked to consider a <br />variance request by Vladimir and Silvia Hugec to allow the construction of an in-ground <br />pool and spa within the required 100 foot buffer setback from the edge of an Open Space <br />Preservation (OP) development at 2931 Jonquil Trail N, <br /> <br />The City Council previously reviewed this application on March 17, 2009, and continued <br />the request to this meeting. The applicants have submitted a revised site plan (Option D) <br />and alternative (Option E) that is consistent with the plan reviewed by the Planning <br />Commission and addresses the Commission’s recommendation that a fireplace and <br />pergola be moved to different locations on the site. <br /> <br />Staff recommended denial of the proposed variances based on a strict review of the <br />variance criteria in City Code. <br /> <br />Council Members Smith and DeLapp visited the site and cited several circumstances that <br />were unique to this property, including: <br />1. The existing home was built further back on the lot leaving little buildable area in <br />the rear yard. <br />2. The proposed pool and spa are similar to the structures in the neighborhood. <br />3. There is adequate room on the applicants parcel to provide screening that will not <br />only mitigate any impacts to the Lake Elmo Park Reserve property to the south <br />but will enhance the current view from the park to the applicants’ property. <br /> <br />MOTION: Council Member Smith moved to approve Resolution No. 2009-022 approving <br />variances from the 100 foot buffer setback required from the edge of an Open Space <br />Preservation District to allow the construction of an in-ground pool and spa at 2931 <br />Jonquil Trail N. as shown in Option D, with the condition that a revised landscaping plan <br />be submitted prior to the issuance of a building permit for the pool identifying at least <br />two staggered rows of evergreen trees along the rear of the property to create a visual <br />buffer from the Lake Elmo Regional Park Reserve. The trees shall not be less than four <br />feet in height and maintained and replaced when necessary. Council Member Park <br />seconded the motion. The motion passed 5-0. <br /> <br />2009 Street Improvements: Approval of plans and specs and ordering advertisements for <br />bids; Resolution No. 2009-023 <br /> <br />Ryan Stempski, Assistant City Engineer, reported the City Council is being asked to <br />approve the plans and specifications for the 2009 street improvements and order <br />advertisement for bids. The project includes the residential streets in the Myron Ellman, <br />Eden Park, Eden Park 2nd, and The Forest subdivisions. Additionally TKDA has <br />completed the design and included the reconstruction plans for the Tablyn Park entrance <br />and parking lot within this plan set to be bid and constructed by the same contractor.
