LAKE ELMO CITY COUNCIL MINUTES APRIL 6, 2004 7 <br /> <br />Council member DeLapp provided a site plan allowing for straightening of the south wall <br />to align with the house. <br /> Mr. Eisele verbally agreed with the modification and will submit new drawings. <br />M/S/P DeLapp/Siedow - to modify the Resolution No. 2004-027 to straighten out the <br />garage as discussed. (Motion passed 5-0). <br /> M/S/P Johnston/Siedow – to postpone this agenda until the April 20 Council meeting subject to new drawings with proposed modifications submitted by Mr. Eisele. (Motion <br />passed 5-0.) <br /> <br />D. Amendment of Zoning Ordinance Fence Standards <br />The City Planner reported the Council was provided with a final draft of the new fence <br />standards section of the City Code. This began as a recommended approach from the <br />City’s zoning consultant, Lane Kendig. While some of Kendig’s proposal remains, the <br />commission made modifications to the original text. The provided graphics that demonstrate the basic fence standards would be a component part of the ordinance, but <br />will appear on a single page in the final code. <br /> <br />Council member Johnston handed out his changes to the fence ordinance and a fence <br />drawing. Council member Siedow felt that one size fence doesn’t fit all the lots. Questions as to what is a large lot or a small lot, what is a short fence or a tall fence <br />required answers. Siedow said he thought chain link fences should be allowed and not by <br />exceptions. Council member DeLapp thought that may be the city should be more <br />specific with the covenants for a development. <br /> Attorney Filla answered Council member Siedow’s question that the City does have the <br />right to make property owners replace a non-conforming fence. <br /> <br />M/S/P DeLapp/Johnston – to direct the staff to set up a workshop to discuss the fence <br />ordinance and invite the Planning Commission either from 6 to 7 before the commission meeting or recess the planning Commission meeting early and then hold the workshop. <br />(Motion passed 5-0). <br /> <br />Council member Johnston explained Mr. Simich said he would be willing to work out a <br />solution to his non-conforming fence with the City and he would like to proceed with that direction. <br /> <br />M/S/P Johnston/Siedow – to authorize the City Attorney to resolve the non-conformance <br />issue . <br /> The Acting Administrator stated he needed to know how he should be negotiating. <br />Councilmember Johnston said we can only support the existing code.
