Minutes of the Fake Elmo Village Council November 4, 1970 Page 2 <br />Dick Lambert and Mr. Spanner came before the Council asking for a <br />Special Use Permit to permit do racing within -the Vill-age of Lake 'Elmo. <br />Location to be within the West of -the SV4- of Section 169,T29,R21 W <br />lying between the Southerly right of way line of the Minnesota State <br />Trunck Highway 212 and the Northerly right of way line of the Chicago <br />Northwestern RR. <br />The Council reviewed the minutes of the Planning Commission regarding <br />this request. Moved by Councilman Abercrombie with 2nd by Councilman <br />Shervheim that we approve the request for dog racing subject to the <br />following conditions which will be spelled out on the Special Use Per. <br />mit. 1Sunday Racing, 1:OOPM to 6:OOPIVI only. <br />2.Saturday racing,, 9:OOAM to 6:00PM only. <br />3.Snow -fence acceptable to: fence in track for duration of 3st yr. <br />4.East border of property to be screened with a planting of Con- <br />ifer Treec. <br />5.Special use permit allowed for 1 year with a hearing prior to <br />re —issuance of special use permit, with official notification <br />to all area residents. Reviewed each year thereafter. <br />6.Owner or operator shall take steps to abate noime or any nuisance. <br />7.Approved site plan filed with. clerk. <br />8.Premises shall be maintained in a safe clean sanitary manner. <br />9.Sanitary disposal systemx shall be approved by engineer and <br />.subject to periodic inspection. <br />10.Pleasing view shall be maintained (no junk, weeds, ill repair). <br />11.1f nuisances occur,the permit may be revoked or amended fol. <br />lowing a public hearing. <br />12.Refer-to. pages 61-63 zoning regulations-- conditions for special <br />use permits. <br />Motion carried 5-0. <br />Letter received from one of the residents of 'Tablyn Park that one <br />additional light was required to complete the lighting of the area. <br />Clerk instructed to write to Mr. Graham of 1VSP and ask for expanation <br />since the lighting was based on NSP recammendationy <br />Arrangements should. be made for a, Public Information Meeting on the <br />possible acceptance of the Metro area. Street naming and Numbering <br />program. Donn. Pepper to be contacted and if such a meeting could be <br />set up in November then set it up if not meeting should be planned for <br />January,. <br />Don Raleigh, Village Counsel, presented a copy of a proposed snowmobile <br />ordinance. Since it was rather involved Clerk was instructed to dist— <br />ribute copies for the Council to study so a decision could 'be arrived <br />at during the November 17, 1970 meetin:. <br />Counsel requested to draw up a Special Use Permit -to cover the requested <br />gun range for the 3M Club. This would be reviewed and a decision due <br />from th; Council at the Novembe*1'7, 1970 meeting... <br />Clerk advised that the judges of the election had submitted the fol. <br />lowing results. For Councilman Lehart Friedrich 721, Jess Mottaz 3559, <br />James Lohmann 1, David Loas 1 and 34 ballots with no vote <br />For Constable James Eder 716, Brian Smith 3209 James Lohmann 19 <br />Willard Eder 1, Al Haseley 1 and 73 ballots with no vote. <br />Motion by Councilman Abercrombie 2nd by Councilman Watson that results <br />of election be approved as presented by clerk and that; Lehart Friedrich <br />and James :Eder be shown.as -the winners of their respective office. <br />Motion carried 5-0n <br />
