R 70 -- :'- <br />RESOLUTION OF <br />VILLAGE OF LAKE ELMO <br />RESOLUTION REGARDING THE PROSECUTION OF CERTAIN ORDINANCE VIOLATIONS. <br />WHEREAS, Complaints have been filed in the Washington County Municipal Court <br />charging five officers and employees of Fischer Construction Company with violation <br />of Ordinance No. 10 of the former Town of East Oakdale regulating the removal of <br />gravel within said Township (now the Village of Lake Elmo); and, <br />WHEREAS, said defendants have all entered pleas of "not guilty" and trial of <br />issues so joined is now pending; and, <br />HHEREAS, said Fischer Construction Company has, since the filing of said complaints <br />against the officers and employees, appeared before the Board of the former Town of <br />East Oakdale and has entered into a permit -agreement with said Town Board and posted <br />a bond conditioned on its proper performance thereof; and, <br />WHEREAS, representatives of Fischer Construction Company have represented to said <br />Town Board and this Village Council as its successor, that the violations of Ordinance <br />No. 10 resulting in said complaints were unintentional; and, <br />WHEREAS, This Village Council while of the opinion that the complaint of <br />violations were and are indefensible but have arrived at the conclusion that said <br />defendants should be given the benefit of any doubt in the interest of the furtherance <br />of justice and in consideration, of the fact that the Fischer Construction Company has <br />bound itself to correct any damage created by the activities of said defendants. <br />NOW, THEREFORE, BE IT RESOLVED That the Village Attorney be authorized to move <br />said Court for a dismissal of said complaints for the reasons aforesaid. <br />BE IT FURTHER RESOLVED, That any violation of ordinances relating to the removal <br />of gravel within this Village, whether on the part of any of the said defendants or <br />any other persons, be promptly prosecuted so as to invoke the maximum penalties <br />provided by law, and, thereby, prohibit and discourage such activities as may be <br />detrimental to the public interests. <br />Dated March 3, 1970. <br />Calvi J.
