Jessamine <br />St. Paul, Minnesota SS101 <br />Dear Mr. Iverson: <br />Pursuant to your visit to this office on April 14, 1971, we have examined <br />our records concerning the water levels of Lake Jane (I.D. No. 82-104), <br />Washington County. <br />No official natural ordinary high water mark for this lake has been <br />established. The Division installed a gage by which to read water levels <br />on April IS, 1967. Zero reading of the gage is an elevation of 917.17 <br />(Sea Level Datum 1929). The maximum reading on this gage in the last three years <br />has been 920.5. The'"average" reading has been in the 918-919 range. <br />Historical estimates have placed the natural ordinary high water mark <br />at a greater elevation, and the original government land survey places the <br />meander line of Lake Jane at approximately the 930 elevation. Our gage <br />readings should not be interpreted as establishing a natural ordinary high <br />water mark, as the readings are available for only a limited number of years. <br />Due to the present character of the shoreline, the Division will not <br />require a permit for filling the area adjacent to the road, as you indicated to <br />us during your visit. However, the Village Council of Lake Elmo has the right <br />to set what development standards it desires in the interest of public health, <br />safety or welfare. You are entitled to access from your lot to the lake over <br />that portion of your lot within the original meander line, and this area should <br />be included when calculating your lot area. <br />incerely, <br />Gene H.
