CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />ORDINANCE NO. 97-177 <br />AN ORDINANCE RELATING TO TRUNK WATER FACILITY <br />AND LATERAL WATER MAIN CHARGES <br />The Lake Elmo City Council hereby ordains that Sections 600.05 and 600.06 of <br />the Municipal Code of the City of Lake Elmo are amended to read as follows; and that <br />Section 600.03 of the Municipal Code of the City of Lake Elmo is repealed: <br />600.05 Plumbing Permits. A permit must be obtained to connect to the water <br />system. The fee for each permit shall be as set forth by City Council <br />Ordinance. No permit shall be issued except to a licensed plumber. All <br />costs to connect to an existing water main shall be paid for by the <br />property owner. If for any reason the contractor laying the service pipe <br />shall fail to have the connection made at the time specified in the <br />contractor's application, notice must be given to the City Building <br />Official affixing another day on which the contractor wishes to make the <br />connection. The notice must be given at least two (2) business days <br />prior to the excavating for laying the service pipe and the connection <br />must be made before 3:00 p.m., except in special cases, and then the <br />work must be done only upon a written order from the City Building <br />Official. <br />600.06 Trunk Water Main Facilities and Lateral Water Main Connection Charges. <br />A connection charge, as determined by City Council Ordinance, shall be <br />paid at the time of making the application for water service. Before the <br />connection permit is issued, the City Administrator shall make the <br />following determination: <br />(1) A lot or tract of land to be serviced by the connection has been <br />assessed for the cost of constructing the trunk water main facilities and <br />lateral water main system with which the connection is made, or <br />(2) If no assessment has been levied for the construction cost of the <br />trunk water main facility and lateral water main, the proceedings for <br />levying the assessments have been or will be commenced in due course; <br />or <br />(3) If no assessment has been levied, and no assessment proceedings <br />will be completed in due course, a sum equal to the portion of the cost <br />of constructing the trunk water main facility and lateral water main has <br />been paid as a connection charge to the City. <br />
