Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />Nov <br />City Council <br />December 19, <br />2006 <br />Agenda Item: Final Plat — Discover Crossing 2°a Addition <br />Background Information for December 19, 2006: <br />The 2006 approval of the PUD Preliminary and Final Plans/Plats of Discover Crossing included 3 outlots <br />designed as building lots that could be re -platted as legal lots in the future responsive to then -contemplated <br />amendments to the Comprehensive Plan that would increase the maximum allowable OP density to 18 per <br />40 acres from 16 per 40 acres. By July, 2006 that Comprehensive Plan to increase OP density to 18 units <br />per 40 acres was approved by both the city and the Metropolitan Council. While the City continues to work <br />toward amending its zoning ordinance text to include that change, whenever a Comp Plan and Zoning <br />ordinance conflict (as they do in this regard today), the Comprehensive Plan prevails. Therefore, the three <br />outlots are eligible for final platting into building lots. <br />The attached Resolution is for approval of the outlot/building lot conversion by Final Plat. All required <br />plans, escrows, Development Agreements and fees involving these 3 lots were addressed/completed by the <br />original Final Plat and Agreement. <br />Action Items: <br />Person responsible: <br />Motion to adopt Resolution #2006 -'y approving the Final Plat of <br />Assistant Planner <br />Discover Crossing 2°d Addition. <br />Attachments: <br />Time Allocated: <br />1.
