rE3t�ITi oTi <br />10. CITY ATTORNEY'S REPORT: <br />A. Opinion on Ladder Trucks Going Out for Bids <br />City Attorney Filla recommended going out for bids for the purchase of a 100' ladder <br />truck for the Fire Dept., and stated that competitive bids are required for purchases over <br />$50,000.00. The LMNC determined there are similar vehicles, and unless it was custom, <br />bids were required and must be published for 10-days. <br />Council discussed it would not be feasible since funding is not available in the 2006 CIP, <br />but possibly in the 2007 CIP with the reprioritizing of fire vehicles. The CIP is a future <br />planning tool, with a projected budget, and is based on future growth. There is a need but <br />that does not necessarily mean commitment. <br />Fire Chief Malmquist stated the ladder truck was an opportunity available. He requested <br />starting the groundwork for future planning, which will also help the City's ISO rating. <br />Homeowners will save money on insurance with the available of a fire hydrant nearby. <br />Council Member DeLapp stated: A) an investment, and B) greatest level of benefit for <br />health, safety and welfare of residents. <br />M/S/F Conlin/Smith — to direct Staff to go out for competitive bids of a 100' ladder truck. <br />(Motion failed 2-3: DeLapp-don't have the money, Johnston -don't have the money and <br />the economy, Johnson -have the need but not financial means) <br />B. Project Director Agreement Modified (verbal) <br />Finance Director Bouthilet informed the Council of the Project Director's request <br />regarding PERA and the word "temporary." City Attorney Filla has reviewed the change <br />requested, and stated it would not change the length of her employment. <br />M/S/P Johnson/Smith — to approve the amended Project Director Agreement. <br />(Motion passed 5-0) <br />C. Legal Update: <br />City Attorney Filla updated Council on the status of the following: <br />1. Tablyn Park/Lake Elmo Heights has been reduced to only two (2) residences <br />denying access to the City for water main hook-up and well sealing. <br />2. Gen -Con is suing the City; the matter has been referred to the League of MN <br />Cities, who will be defending the City. <br />3. 8475 Hidden Bay Trail — it is scheduled for Court tomorrow. <br />11. CITY ADMINISTRATOR'S REPORT: None <br />12. CITY COUNCIL BUSINES AND REPORTS: <br />A. Mayor Johnston informed Council that the St. Croix Family Center Team selected <br />Lake Elmo and voted unanimously to talk with Lake Elmo endorsing Phase I. He invited <br />the Team to attend the December 12, 2006, Council workshop. <br />
