DRAF <br />have to pay for the increase in property value. If the project is approved tonight, we will begin <br />construction in April 2006. <br />THE MAYOR OPENED THE PUBLIC HEARING AT 8:40 P.M. <br />Jill Smith, 3M Real Estate Department <br />Ms. Smith asked Administrator Rafferty who he spoke to at 3M about this project. She said <br />she is interested in the process of determining benefit to property owners, and why the 3M <br />parcel was different. She would like to see that assessment. She said their property is not <br />zoned commercial at this time, and she would like to see how that worked. She asked if <br />MUSA is planned for that parcel. She asked the process for hooking up in the future. She <br />asked how interest is determined. <br />Engineer Prew said the assessment was per acre. The Mayor said MUSA is not planned for <br />the next 25 years in that area. Engineer Prew said generally a second hearing is held for <br />assessment, repayment term, and interest. <br />Dennis Ostrander <br />Dr. Ostrander is the veterinarian whose hospital sets back by Animal Inn. He said there is an <br />assessment on an easement access. He asked if there is any legal recourse if he does not want <br />the water. <br />The City Attorney explained this is not a special assessment hearing, this hearing is to <br />determine whether to go ahead with this project. Anyone proposed to be assessed, will get a <br />notice before that hearing. Generally if someone is not assessed and hooks up later they pay a <br />connection charge equal to what the assessment would have been. If it is specially assessed it <br />will be on the tax rolls accruing annually, <br />THE MAYOR CLOSED THE PUBLIC HEARING AT 8:47 P.M <br />Councilmember DeLapp said we have to do this project for our water system but people <br />should not have to pay for water they don't want or need. <br />M/S/P, Smith/Conlin, To adopt Resolution No. 2006-09, A Resolution Ordering Improvement <br />and. Preparation of Plans for the Water System Interconnection Phase IV Project. <br />Councilmember DeLapp said it is critical for people coming to a hearing to know what we <br />plan to assess them. The City Attorney said the City should withhold the size of assessments <br />until all the facts are gathered. <br />VOTE: 4:1 Nay-DeLapp, <br />THE MEETING RECESSED FOR FIVE MINUTES AT 8:51 AND RECONVENED AT 8:56 <br />P.M. <br />9. Planning, Land Use & Zoning <br />a. AustadlPierre/Hart — Wastewater Treatment <br />The Planner explained that three properties have a history of septic system problems. The <br />property owners engaged a septic designer to look at the DeMontreville Wildlife Area as well <br />as a second area when the first did not come out as well as hoped. It would be constructed by <br />Lake Elmo City Council Minutes of January 17, 2006 <br />
