Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9C <br />City Council <br />January 17, <br />2006 <br />Agenda Item: Appeal of Administrative Order - Sessing <br />Background Information for January 17. 2006: <br />At its December 6, 2005 meeting the City Council directed the City Staff to issue an Order to the Sessings <br />at 5699 Keats Avenue directing certain actions by the Sessings to bring their property into compliance with <br />certain City Code provisions. Copies of draft December 6 City Council minutes reflecting its direction to <br />the City Staff, and the Building Official/Code Enforcement Officer's December 16, 2006 Notice and Order <br />are attached. <br />On December 20, 2005 the Sessings appealed Mr. McNamara's December 16, 2005 Order. The appeal was <br />timely, and a Notice of Hearing before the Board of Appeals and Adjustments has been properly Noticed <br />for January 17, 2006. A copy of the Sessing appeal is attached, together with a December 6, 2005 letter <br />from the City Attorney that addresses some of the issues in this appeal. <br />A Public Hearing should be conducted as Noticed. <br />Person responsible: <br />Action items: <br />Motion directing staff to prepare a Resolution regarding the <br />City Planner <br />subject appeal. <br />Attachments: <br />Time Allocated: <br />1.
