Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9B <br />City Council <br />June 20, 2006 <br />Agenda Item: Zoning Variances — 9429 Jane Road (Hamerly) <br />Background Information for ,Tune 20, 2006: <br />At its meeting June 12, 2006 the Planning Commission conducted the Public Hearing and unanimously <br />adopted a recommendation for approval of street yard (front) and side yard setback variances to enable the <br />applicant to raze an existing detached garage and replace it with a new attached garage in nearly the same <br />location on the site, but designed to provide indirect access onto Jane Road rather than the present <br />requirement that the residents' vehicles back directly onto Jane Road from the existing garage. The <br />Commission added a design modification as an additional condition to the approval recommendation that <br />would require the applicant to encroach no further on the side setback (including eaves) than the existing <br />garage encroaches - to approximately 5 feet of the property line (footprint, excluding eaves). This <br />additional condition will result in some modification to the design of the proposed attached garage, and is <br />added to the draft approval Resolution attached. <br />The City received the attached letter from the property owner to the south of the applicant (the side where <br />the setback variance would occur) following the Planning Commission meeting/Hearing. The letter clearly <br />states that the neighboring property owner (the party most impacted) supports the variance requests. <br />Person responsible: <br />Action items: <br />Motion to adopt Resolution #2006 — approving street and side <br />City Planner <br />yard setback variances for construction of an attached garage at <br />9429 Jane Road, based on the Findings and conditions <br />recommended by the Planning Commission, and plans staff dated <br />June 12, 2006 as modified by the approval conditions. <br />Attachments: <br />Time Allocated: <br />1.
