DRAFT <br />M/S/P, Ptacek/Schneider to amend Code definitions adding Section 1115 to licensing and amending <br />,zoning districts as presented in the Planner's Staff Report. <br />Commissioner Roth asked about stock in trade. <br />Commissioner Ptacek said asking for hard specific square footages would be detrimental to the <br />public health, safety, and welfare and when he asked how much garage square footage for stock in <br />trade would be the limit, nobody could answer that question. <br />VOTE: 8:0. <br />Public Hearing: Consider Code Amendment — <br />Wedding Events in AG Zoning District <br />The Planner said the draft Code amendment is generic for all AG properties. The City of Stillwater <br />said they have a CUP or SUP for musical events. The Planner took Commissioner Armstrong's <br />factors into consideration and drafted for Municipal Code 300.07, 4.A.2. to add another Conditional <br />Use to those already there, this one for Outdoor Social Events with nine conditions. He said that is a <br />more contemporary way to draft an ordinance. <br />The Planner distributed a letter from Carol Palmquist received on March 1, 2006. <br />Commissioner Deziel asked about Item 4, limiting to 200 people is unreasonable and should be <br />higher or relate to available space. Item 6, he asked why limit to six hours as long as events are <br />conducted within the hours allowed. <br />Chairman Helwig said why not make it once per week instead of two. He thinks no liquor should be <br />allowed.. <br />The Planner said that is a separate issue, not a zoning issue. <br />Commissioner Fliflet asked for clarification about no permanent or new structures allowed. What <br />about a gazebo? <br />The Planner said a homeowner could build a gazebo and other buildings, and then create a business <br />to fit it. Tents are gone when the event is over. The Commission could modify the no permanent or <br />newly constructed structures provision. Building Permits are not use regulated. <br />Commissioner Roth said indoors is one thing but as drafted, this is strictly an outdoor use. <br />THE CHAIRMAN OPENED THE PUBLIC HEARING AT 8:05 P.M. <br />Nobody spoke. <br />THE CHAIRMAN CLOSED THE PUBLIC HEARING AT 8:06 P.M. <br />Commissioner Deziel said that 200 people on 10 acres may seem cramped. We might want to limit <br />to no more than ten people per acre. <br />M/S/F, Deziel/Roth To limit No. 4 for Outdoor Social Events to ten guests per acre. <br />Commissioner Ptacek thinks ten acres is adequate for 200 people. <br />Lake Elmo Planning Commission Meeting Minutes of March 13, 2006 <br />
