Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9C <br />City Council <br />March 6, 2006 <br />Agenda Item: Ordinance Relating to Private Wells/Resolution Declaring Potential Hazard <br />Background Information for March 6, 2006: <br />The Minnesota Department of Health has advised the City that insuring the absolute containment of the <br />PFOA/PFOS that has been detected in some Lake Elmo wells requires abandonment and sealing of all <br />private wells within the area of the City where those chemicals have been detected in some wells, and may <br />appear later in the others. While there may not be conclusive evidence at this point that those chemicals are <br />a public health risk, there is sufficient concern by the Minnesota Health Department that there may be such <br />a risk that it is unwise for the City to allow water from wells with present detections or those that are in <br />proximity that may have future detections to be used for any purpose — including lawn/garden irrigation and <br />similar non -drinking water applications. <br />To that end the City Attorney has drafted an ordinance that requires the sealing of any well in the City <br />which has been declared a health hazard by resolution of the City Council; and, a Resolution that declares <br />all private wells within the West Central Lake Elmo Area (WCLE), as defined by the Minnesota <br />Department of Health, to be a known or potential health hazard, and ordering that all such wells be sealed <br />upon the availability of a City water system. <br />Person. responsible: <br />Action items: C- 6 <br />�In'er/City <br />1.
