The trees would be planted inside <br />the right-of-way rather than on the private lots, which are required to have 10 additional trees. <br />The Development Agreement, all HOA documentation, and easements have been reviewed by the City <br />Attorney. All construction plans have been approved by the City Engineer for compliance with current OP <br />and Subdivision design standards of the City. Open Space easements have been drafted to run to the City <br />pending a decision and processing from Minnesota Land Trust. No easements for the Open Space will be <br />recorded until Land Trust activity is complete. The Park Superintendent is reviewing Public Park <br />development plans. The $40,000 minimum developer expenditure for those improvements is addressed by <br />the Development Agreement. <br />M/S/P Siedow/DeLapp — to approve Resolution No. 2000-03, approving the Final Plat and Final OP <br />Development Plan of Tana Ridge, based on the consistency with the approved Preliminary Plat/plan and <br />the City Code requirements for a Final Plat and authorize the Mayor and City Administrator to enter into <br />the Development Agreement. (Motion passed 3-1:Armstrong:Lots are too small. If we are trying to keep <br />the rural character this is not what we are after with the OP concept. We are going overboard on small lots.) <br />B. Final Plat: Final Plat OP Plat/Plan and Development Agreement - Fields of St. Croix 2"d Addition <br />Planner Dillerud reported a Conditional Use Permit for non-residential use of Outlet A was denied by the <br />Council. Since the approved Concept Plan did show a "Farmstead Market" use in Outlet, the City can <br />expect the developer to resubmit a CUP request, Site Plan, and replatting for this outlet in the future at a <br />reduced scale from that which was denied. Outlets are not eligible for building permits. The plat/plan <br />approval assumed transfer of 17 "unused" units from the Phase I Fields Plan with transfer of 2 units to the <br />Tana Ridge Plan. <br />The landscape plan submitted meets the requirements of Chapter 300 by providing for 697 new trees where <br />660 are required by the 10 trees/lot formula. Council member DeLapp would accept the landscape plan <br />with the planting of the required trees inside the blvd., as code indicates. There was concern regarding the location of the trail corridor extending west <br />and south from the development to the direction of the Old Village. <br />M/S/P Siedow/DeLapp — to approve Resolution No. 2000-04 approving the Final Plat and Final Op <br />Development Plan of Fields of St. Croix, Phase 2 based on consistency with the approved Preliminary <br />Plat/Plan and the City Code requirements for a Final Plat and authorizing the Mayor and City <br />Administrator to sign the Development Agreement. (Motion passed 3-1:Armstrong: the lots are too small, <br />74% in townhouses that are less than .6 of an acres, the transfer of density was not a valid operation.; Dunn <br />The staff and Council are working with our OP code so we don't have the small lots.) <br />9. CITY ATTORNEY'S REPORT: None <br />10. CITY COUNCIL REPORTS: <br />Council member DeLapp reported on an article in the New York Times reporting 1000 barns a year are <br />destroyed in Iowa alone. The City of Lake Elmo has saved 4 barns. <br />Council member Dunn pointed out that March 7 is Precinct Caucus night so they would have to reschedule <br />Council meeting.
