The <br />Council indicated to staff that they are working in the right direction and to look into ways of incorporating <br />the concepts of last four suggestions. <br />Brian Tjosvold, who is developing a 40-acre parcel next to Parkview Estates, asked that he be <br />grandfathered in with the same OP regulations followed in developing Parkview Estates. A road, 16"' <br />Street, was stubbed off from Parkview to his property. Council member Dunn told Mr. Tjosvold this <br />discussion on changing OP regulations just didn't come up; the Council has been hying to improve OP <br />since November, 1999. Planner Dillerud indicated he did not have any authority to grandfather in such a <br />request. <br />M/S/P DeLapp/Dunn — to direct the staff to proceed with the draft of OP Ordinance Amendments, as <br />suggested in the City Planner's memo, with the criteria suggested by the Planner to become mandatory, <br />with the recognition that exact numbers are not determined. (Motion passed 5-0.) <br />Planner Dillerud will have the draft OP amendments for the April 18 Council meeting, but will not be in <br />attendance. The Council might need to set up a Saturday workshop. <br />C. Staff Recommendation on Hwy 5/Manning Intersection Realignment Investigation <br />City Planner Dillerud provided a report on the proceedings by the Highway 36 Technical Committee. The <br />Planner recommended that the Council consider directing an independent and more detailed analysis of the <br />Highway 5/Manning realignment concept and pursue investigation of realignment alternatives for the State <br />Highway 5/Manning intersection, including Work Plan and cost -of -study estimates. <br />M/S/P DeLapp/I-lunt — to direct the City Engineer to pursue further investigation of realignment <br />alternatives for State Highway 5/Manning intersection and Highway 5/CSAH17 intersection. (Motion <br />passed 5-0). <br />D. Eagle Point Business Park Final Plat and PUD Development Agreement <br />City Planner Dillerud reported that because the HDR project (north of Hudson Road) is not as yet ready, <br />United Properties proposes to initially plat only the area south of Hudson Road as lots/blocks. He balance <br />of the site, approximately 105 aces, will be platted as a single Outlot. Outlots are not eligible for building <br />permits until they are replatted, and, the replat must be separately approved by the City Council. <br />Based on the foregoing, the manner in which the developer proposes to process this project is to replat <br />portions of the Outlet into buildable lots/blocks as specific site plans for tenants are approved. The first <br />Development Agreement becomes a master, the terms of which apply to the entire plat, whether now as <br />lots/blocks or as outlots. The agreement is set up to anticipate supplements that will address only that <br />portion of the outlots that is being Final Platted at this time. These supplements will address the public <br />improvements to be constructed with that portion to be platted. <br />Tom Prew suggested, through state aid system, build as a state aid street, then collect from developer for <br />his costs. By Collecting from the developer and state aid funds, which net is $200,000 would be available <br />to spend elsewhere in the community. Design would be priced, our engineer and theirs will work on specs. <br />The developer would build the street base and at the same time put in laterals. The City will then come in <br />and build a state aid street. The Development Contract is set up on that basis. <br />Washington County has said three traffic lights would be installed based on a cost sharing formula —the <br />City has no responsibility. Council member DeLapp stated he would not subsidize a traffic light that <br />doesn't benefit the entire city. Hunt suggested we could post City road with only right turn lane. The City <br />disagreed with Washington County's plans for traffic lights and would contact our County Commissioner <br />with concerns. Council member DeLapp has a problem with the 30' height for lights, the number of docks <br />and no odors on or off the site.
