M/S/P Siedow/Dunn - to amend Section 4.07 of the Development Agreement, the date for <br />City Improvements from November 15, 2000 to December 15, 2000. <br />(Motion Passed 5-0). <br />M/S/P Siedow/DeLapp - to amend the Development Agreement Section 4.01 F. Lateral <br />Water Mains: Lateral water mains shall be sizes and diameter as ap roved by the City <br />Engineer, and the improvement shall be completed on or before the 30 ' day of November, <br />2000. Lateral water mains shall be dedicated to the City. <br />(Motion Passed 5-0). <br />Council Member DeLapp asked why the Park Dedication fee was so low. Planner Dillerud <br />explained that based on a certified appraisal by the City Assessor, completed to Chapter 400 <br />requirements, those specify that the appraisal is made on the raw land value prior to development. <br />He said the concern expressed by Councilor DeLapp is he understands that Mr. Arkell purchased <br />the land well in excess of what the assessor has it valued. He explained that the purchase price paid <br />by Mr. Arkell was reflective of the assumption that the land would be developed in Oak Park <br />Heights at a use intensity far in excess of that in Lake Elmo. He noted that the assessor couldn't <br />make changes based on the selling price of property. <br />M/S/P DeLapp/Siedow - to adopt Resolution 2000-023, A Resolution approving the Final <br />Plat and PUD Development Agreement for Carriage Station. <br />(Motion Passed 3-2). Opposed: Dunn and Armstrong - based upon the recommendation <br />from the Planning Commission to deny. <br />M/S/P DeLapp/Siedow - to adopt Ordinance No. 9758, an Ordinance amending Section <br />300.07 "Zoning District Map" of the Lake Elmo Municipal Code, reclassifying Lot 15, Block <br />1 and Lots 2-6, Lots 1-14, Block 1 of Carriage Station, from unclassified to Limited Business, <br />and from unclassified to R2 One and Two Family Residential, respectively. <br />(Motion Passed 3-2). Opposed: Dun/Armstrong - based upon the recommendation to deny <br />from the Planning Commission. <br />9.17 Tax Abatement: Set Hearing Date <br />M/S/P DeLapp/Dunn - to direct staff to publish Notice of Public Hearing regarding Tax <br />Abatement to be held July 18, 2000; and, to direct the City Attorney to prepare the <br />appropriate Tax Abatement Resolution to be considered July 18, following the hearing. <br />(Motion Passed 5-0). <br />10.
