Standards as follows: <br />j. In the event that the property owner, or future property owner, initiates a Comprehensive <br />Plan Amendment and Rezoning of any or all of the contiguous real estate from <br />Agriculture to a more intensive use, the Conditional Use Permit shall terminate with all <br />non -conforming structures removed within one year from the date of the City Council's <br />adoption of the Comprehensive Plan Amendment and rezoning, unless the City agrees <br />otherwise. This section shall not apply if the City initiates rezoning or if property owner <br />is forced to transfer title to any part of the contiguous real estate due to Eminent <br />Domain. <br />(Motion Passed 5-0). <br />M/S/P Dunn/DeLapp - to approve Ordinance No. 9757, as amended, and include Section <br />2 in "Definitions" - Section 150 of the Municipal Code, and Section 3 to appear as Section <br />300.07 Subd. 6. <br />(Motion Passed 5-0). <br />M/S/P Dunn/DeLapp - to amend item j. of Ordinance No. 9757, to include removal of all <br />nonconforming structures from the site within one year from the date of adoption of the <br />Comprehensive Plan Amendment and rezoning. <br />(Motion Passed 5-0). <br />M/S/P Dunn/DeLapp - to adopt Ordinance No. 9757, as amended, including Section 150 - <br />Definition of Non -Agricultural Low Impact. <br />(Motion Passed 5-0). <br />9.0 Old Village Planning Area: 2000 - 2020 Comprehensive Plan Amendment <br />Planner Dillerud will bring the update concerning the Comprehensive Plan to the City Council at its <br />July 18, 2000 meeting. <br />9.E Final Planned Unit Development, Final Plat, Zoning & Development Agreement: <br />Carriage Station. (Res. No. 2000-024) <br />Planner Dillerud stated that Carriage Homes IX (Stillwater Investment Co.) had applied for the Final <br />PUD Plan, Final Plat and development Agreement approval for the 110 home and 4.5 acre Limited <br />Business neighborhood. He noted all grading and infrastructure construction plans have been <br />reviewed and approved by the City Engineer and the Development/PUD Agreement has been <br />reviewed and approved by the City Attorney. He explained that staff has reviewed the Final Plat and <br />found the drawings in conformity with the approved Preliminary Plat, and Chapter 400 standards <br />for conventional plats and that the Valley Branch Watershed District permit has been issued. He <br />said the City Engineer also approved the design of the Wetland Treatment System, and an MPCA <br />Permit for the system has been applied for, but not yet issued.
