On behalf of the applicant, Tim Freeman asked the Council to table CUP <br />and rezoning 30 days to give the applicant time to reexamine options so this <br />is not a dead deal and to extend 60 day for review time. <br />M/S/P DeLapp/Dunn - to table the CUP and rezoning for 30 days to give the <br />applicant time to reexamine options and to extend 60 day for review time <br />based on request of the applicant. Amendments to the Open Space Zoning Ordinance <br />Planner Dillerud reported at its January 26, 2001 meeting, the Planning <br />Commission adopted a recommendation regarding amendments to the OP <br />Ordinance on which the required Public Hearing was conducted on January <br />8, 2001. The draft ordinance produced by the City Attorney and Planner <br />reflected the Council's direction and modifications. <br />Tim Freeman, Folz, Freeman and Dupay, has done many Open space <br />developments with the ordinance in place, but found the wetland treatment <br />systems are not allowed in the ordinance. <br />Mayor Hunt talked to Bob Engstrom who passed on concerns on setbacks <br />and stormwater ponds. Hunt liked the 3 to 1 aspect ratio and some form of <br />buffering, <br />Planner Dillerud asked if someone sees a mechanical problem in the <br />ordinance let him know and he will address it. There is No OP plat in the <br />process now. <br />With all respect to the input from Tim Freeman, Council member <br />Armstrong stated the Planning Commission, the City Planner, Council has <br />worked hard on this OP ordinance. They know what direction we want to <br />take the City and do not take direction from a developer or from the outside, <br />and made the following motion: <br />M/S/ Armstrong/Dunn — to adopt ordinance no 9774, repealing Section <br />300.07,0 (Present OP Ordinance); and, replacing it with Section 300.07.P. <br />(New OP Ordinance). <br />LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 6, 2001 7 <br />
