If the City changes the guiding, then it would cite reasons for <br />doing so. <br />Attorney Christopher Dietzen, representing the Reco property owners, <br />reviewed matters in his letter of December 19, 2001 presented at an earlier <br />Council meeting and his April 2, 2001 letter, which was handed out. He <br />stated that Reco has owned the property for over 30 years and are unaware <br />of any evidence that the site was ever considered for residential use or was <br />considered appropriate for such use. Mr. Dietzen displayed a sketch <br />showing how the land could be divided into commercial lots. He advised <br />the Council that following an earlier meeting with the Mayor and <br />Administrator he had understood Reco would receive some notice of <br />Council consideration of the new Land Use Plan. <br />Pat Regan, officer of Reco, one of 7 in family that own the property, stated <br />the City designated the land LB so they decided to continue to own the <br />property. The Planning Commission told them that a concept plan did not <br />need to be dealt with at that time. Since then he met with staff and Mayor. <br />Planner Dillerud responded when the concept was presented at the Land <br />Use Plan Hearing, the Planning Commission told Reco that no application <br />was submitted, so this was not the forum to discuss the concept. Due <br />process for a comprehensive plan is to hold a public hearing in front of the <br />Planning Commission. Reco was there and was heard. How could there be <br />a problem with due process? <br />Administrator Kueffner said that she and the Mayor met with Mr. Regan <br />after the Planning Commission hearing, and told them they could not make <br />any promises. She said Reco has GB zoning now. It was her opinion that <br />LB guiding would be reasonable compromise. <br />Mayor Hunt asked the Council if they want to reconsider the guide plan for <br />this property. Council member Siedow answered the land should be LB <br />land use classification on I94 corridor.
