WHEREAS, at its May 7, 2002 meeting, the lake Elmo City Council <br />reviewed the application of Nass/Buberl/Bidon for a Comprehensive Plan <br />Amendment; the City Planner's memo of April 17, 2002; and the <br />recommendations of the City's Planning Commission. <br />WHEREAS, the Lake Elmo City Council has reviewed its records <br />regarding the adoption of the City's 2000 Comprehensive Plan (See City <br />Planner memo dated Apri117, 2002) and has determined that the City's <br />2000 Comprehensive Plan Land Use Map designations for this site were <br />not the result of error and that the conditions relating to the site and its <br />surroundings have not changed significantly since the adoption of the <br />City's 2000 Comprehensive Plan. <br />M/S/P DeLapp/Dunn — to adopt Resolution No. 2002-037, as amended by the <br />City Attorney, A Resolution Denying the Application of Nass/Buberyl/Bidon <br />for Land Use Plan reclassification from RAD to C based on the <br />recommendation of the Planning Commission and the Findings contained in <br />the Resolution. (Motion passed 5-0). <br />G. Sunfish Ponds Open Space Concept Plan <br />Planner Dillerud reported the Planning Commission held a public hearing <br />regarding this Open Space Preservation Concept Plan application to develop <br />a combined site of 40 acres with 16 single family detached building sites. <br />The Commission recommended approval of the OP Concept Plan; subject to <br />design modification as follows: <br />1. Those conditions recommended by the April 2 Planning Staff Report <br />(Wetlands Evaluation, MN Land Trust comments, and outlot redesign.) <br />2. Relocation of some building lots to more northerly portions of the site <br />— at a minimum reversing Outlot B with Blocks 2 and 3. <br />3. Reduce the length of the cul-de-sac streets to increase the continuing <br />of the Preserved Open Space on the south periphery of the site. <br />The notices for the April 8, 2002 public hearing were sent out on a 10 day <br />cycle rather than a 14 day cycle. Attorney Filla recommended the Council <br />conduct a public hearing on this application. <br />Mayor Hunt opened up the Public Hearing at 9:20 p.m. <br />Neal Krueger, 4452 Lake Elmo Avenue N., explained when the MN Design <br />Team visited Lake Elmo, the message from the residents were "Listen to The <br />Land". This residential proposal takes 40 acres of farmland for which the <br />highest and best use is Ag. He pointed out the outlots do not give contiguous <br />open space and the scenic vista is severely interrupted by the high homes on <br />the berm. He felt this residential concept plan did not meet the intent and <br />spirit of the Open Space Ordinance. <br />Doug Olson, 3834 Kindred Way, stated his concern with wetlands and water <br />runoff from that area.
