3. PUBLIC INOUIRIESANFORMATIONAL: <br />A. Amendments to Snowmobile/ATV regulations: Sgt. Jerry Washington <br />County Water, Parks & Trails Cusick, <br />Sgt. Jerry Cusick, Washington County Water, Parks & Trails, provided recommendations <br />for amending Section 1010 Snowmobiles and ATV Regulations. He suggested that the <br />City adopt Chapter 84 of Minnesota Statutes regulating recreational vehicles and <br />snowmobiles. This would eliminate the need to repeat laws that are already currently in <br />place in MN statutes. <br />There was Council consensus to enforce current posed street speed limit, and prohibit <br />operation of a snowmobile or all terrain vehicle between the hours of 11:00 p.m. and <br />7:00 a.m, and to eliminate the 100 foot requirement of any residential dwelling because it <br />would be difficult to measure. Council member Dunn pointed out that this 100' <br />requirement was instituted because there are several places where trail caused the <br />snowmobile headlights to shine into people's bedrooms. Also, the definition of <br />Boulevard should be included in the ordinance. <br />Staff was asked to send a copy of the draft amendments to Sgt. Cusick and to the North <br />Star Trail Snowmobile Club for their comments. Council member Dunn suggested a map <br />be drafted designating the ski trails along Highway 5 because historically the right-of- <br />way is narrower and winds along Highway 5. <br />M/S/P Johnston/Dunn — to direct the City Planner and City Attorney to incorporate <br />comments and suggested language from Sgt. Cusick and the City Council into a draft <br />ordinance regulating snowmobiles and all terrain vehicles, if possible within the next two <br />weeks. (Motion passed 3-0). <br />4. CONSENT AGENDA: <br />A. Lease Agreement with Washington County Fairgrounds for Clean Up Day <br />Clean Up Day is scheduled for Saturday, May 3, 2003, 8 a.m. until Noon, at the <br />Washington County Fairgrounds. The Washington County Ag Society has provided a <br />lease agreement for Clean Up Day in the amount of $150.00 ($50 down payment/damage <br />deposit and $100 rental). <br />M/S/P Dunn/Johnston — to approve the lease agreement, as amended (Lake Elmo Clean <br />Up Day be changed to City of Lake Elmo, with the Washington County Ag Society for <br />use of the Fairgrounds for Lake Elmo Clean Up Day, Saturday, May 3, 2003, 8 a.m. until <br />Noon in the amount of $150.00.
