57404 <br />WHEREAS subsequent to the time the State was preparing the plans to include said <br />access service road connection, the Village decided that it would be desirable <br />that the.Village should plan and construct a village street to connect said <br />diamond interchange Trunk Highway No. 94 over Trunk Highway No. 12 with Minnehaha <br />Lane; and <br />WHEREAS the Village has prepared plans and proposed to let a contract to construct <br />Helmo Avenue, as an access street between Minnehaha Lane and the west edge of the <br />Trunk Highway No. 12 - Trunk Highway No. 94 diamond interchange as shown on the <br />attached sketch marked "Exhibit All; and <br />WHEREAS the owner of the property, State's right of way negotiation Parcel No. 16A, <br />has indicated his willingness to dedicate to the Village, without cost or expense <br />to the Village, the necessary right of way required by the Village to construct the <br />portion of the access road (Helmo Avenue) that lies within the owners property in <br />consideration of the Village constructing said access road without cost to the owner <br />of said property; and <br />WHEREAS the State has requested that the Village acquire the access control along <br />both sides of the proposed access road, (Helmo Avenue) from the westerly right of <br />way of Trunk Highway No. 94 to 300 feet northwesterly of said right of way line <br />and the Village has indicated its willingness to acquire said access control <br />without cost or expense to the State; and <br />WHEREAS the State prepared an estimate of cost for constructing the aforesaid <br />-3- <br />
