57404 <br />proposed access service road connection, which access service road was deleted <br />from the State construction plans for said State Project No. 8282-06 (T.H. 94= <br />392), grading. Said construction work for the said deleted access service road <br />consisted of grading, aggregate base, aggregate shoulders, plant mixed base <br />and plant mixed bituminous surfacing to provide a 24-foot width surfaced roadway <br />approximately 1200 feet in length to Morgan Avenue which said access service road <br />connection was planned to provide access for the owner of State's right of way <br />acquisition Parcel 17 for Trunk Highway No. 94; and <br />WHEREAS in consideration of the Village constructing said Helmo Avenue, a Village <br />Street, from Minnehaha Lane to the aforesaid Trunk Highway No. 12 - Trunk Highway <br />No. 94 interchange which Village street will provide access to the aforesaid <br />property, isolated by Trunk Highway No. 94 construction, the State has indicated <br />its willingness to reimburse the Village ah amount equal to the estimated con- <br />struction and engineering costs for the State to construct the aforesaid access <br />service road connection to be deleted from the State's construction for Trunk <br />Highway No. 94 plus an amount equal to the State's savings in right of way <br />acquisition costs for the said State's trunk highway project as a consequence of <br />the deletion of the planned said access service road connection; and <br />WHEREAS Minnesota Statute 161.20 authorized the Commissioner of Highways to make <br />arrangements with and cooperate with any governmental authority for the purposes <br />of constructing, maintaining and improving the trunk highway system. <br />IT IS, THEREFORE, MUTUALLY AGREED AS FOLLOWS: <br />MEN <br />
