and encumbrances, an easement as described above over said Lot Six (6), and <br />upon payment by Charles W. Graves of any costs the Village has incurred in the <br />acquisition of the present conditional title to said Lot Five (5) and any costs <br />of these proceedings, the Village will release by appropriate instrument its <br />claim to the use of Lot Five (5) for parks so that the same may revert to the <br />State of Minnesota and be re -purchased by the owner before forfeiture by said <br />Howard L. Huebner. <br />IT IS FURTHER RESOLVED, that the Mayor and Clerk are authorized to execute <br />said agreement and other instruments and conveyances necessary to carry out the <br />transaction herein provided for; and <br />HE IT FURTHER RESOLVED, that said hots Five (5) and Six (6) together, subject <br />to said drainage easement shall be determined a buildable lot provided any <br />improvements and structures to be erected thereon shall be erected in a manner <br />approved by the Village Engineer, who is hereby directed to locate any such <br />structure or improvements in such a manner as to insure that any use or encroach- <br />ment on said Village duainage easement will not interfere or interrupt the Village's <br />use of said easement for the purposes intended. <br />Adopted by the Village Council this 5th day of June, 1973. <br />Calvin J.
