R-73-25 <br />RESOLUTION <br />VILLAGE OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION DIRECTING THE ACQUISITION OF LAND FOR STREET <br />PURPOSES AND AUTHORIZING CONDEMNATION PROCEEDINGS. <br />WHEREAS, it has been determined by the Village Council <br />of the Village of Lake Elmo that it is necessary, advisable, <br />and in the public interest for the Village to acquire right- <br />of-way for the construction of certain street improvements <br />in the Village of Lake Elmo heretofore designated the "Minnehaha/ <br />694 Ramp Expansion Project"; and <br />WHEREAS, in order to accomplish this purpose it is necessary <br />to acquire the lands described in "Exhibits A" and "B" attached <br />hereto, which lands are owned by the persons indicated in said <br />exhibits; and <br />WHEREAS, the Village Council is advised and believes that <br />the most feasible location for said improvement is on the lands <br />described in "Exhibits A" and "B"; and <br />WHEREAS, it is necessary for the Village to acquire said <br />lands forthwith in order to coordinate its construction activities <br />with the construction activities of the Minnesota State Highway <br />Department in the interest of economies in construction; and <br />since it appears that such acquisition will be accomplished by <br />the Village only through the exercise of its right of eminent <br />doraain : <br />NOW, THEREFORE, BE IT RESOLVED thatthe Village Council <br />proceed to procure title to said lands under its right of eminent <br />domain and that the Village Attorney be, and he hereby is, <br />directed to file the necessary Petition therefor and to prosecute <br />such action to a successful conclusion or until it is abandoned, <br />dismissed, or terminated by the Village or by the Court; and that <br />the Village Attorney, the Mayor, and Clerk do all things necessary <br />to be done in the commencement, prosecution, and successful <br />termination of said action. <br />Adopted by the Village Council this loth day of July, 1973. <br />Calvin J.
