Donald Olson Special Use Permit Lake Elmo Heights plat Minutes of Lake Elmo CouncilMeeting May 7, 1974 Page 1 Meeting called to order at 7:32 p.m, by Mayor Eder Present: Eder, Pott, Brookman, Abercrombie and Shervheim (9:54) Also present: Bldg. INsp. Mueller, Council Raleigh, Engineer Bonestroo, PZC members Lyons and Williams and Tri-lakes members Brandon and Hedges. Adm. of Oath: Clerk administered the oath of office to appointed councilman Calvin Brookman. April 16, 1974: Motion by C. Pott second by C. Abercrombie to approve minutes of April 16, 1974 as submitted. Carried 3 - 0. C. Brookman abstained since he was not on council 4-16-74. April 30, 1974: Motion by C. Pott second by C. Abercrombie to approve the minutes of the April 30, 1974 meeting as submitted. Carried 4 - 0. Pet Cemetery Special Use Permit - Letter to Mr. Lambert requesting that he (Lambert): furnish a letter from the bank to accept the responsibility as successor trustee. 1974 Rd. Work:Motion by C. Pott second by C, Abercrombie to approve sealcoating the —following streets in 1974, 1. Harvester (1/2 mile) Cty. Rd, 13 west to limits. 2. Tablyn Park all streets (4/5 mile) 3. 20th St, Cty, Rd 15 o Cty, Rd. 17 (1 mile) 4. Legion from 30th St. South (1/4 mile) 5. Upper 33rd St. Klondike to Cty, Rd. 17 (1/2 mile) 6. Klondike, 33rd to Hwy, 212 (1/8 mile) 7. Upper 33rd. Circle - Complete (1/8 mile) Motion carried 4 - 0. L. E. Hard- Joe Rogers wants to add a 225' X 60' X 18' storeage bldg. with wood Lbr.- a concrete floor. Bldg. Insp. Mueller recommended approval. Bldg. Permit: Motion by C. Abercrombie second by C. Brookman to approve permit subject to plans meeting approval of village engineer. Carried 4 - 0. NW Bell Motion by C. Pott second by C. Brookman that cable be buried Buried Cable: 30".if in right of way it should be 5' from edge and if it is on private property it should be 5' out of the right of way. Carried 4 - 0. J&W Rd, Excavating has been going on without a permit. Bldg. Insp. Mueller Works: explained details. Council directed Mr. Griffin to submit a plan showing elevations bearing in mind nature of adjoining property and maintaining a minimum 4-1 slope. Mr. Girffin advised that he would have plan to bldg. insp. this week. Council also suggested that Mr. Griffin contact Lampert Lumber and determine what landscaping plans they may have. Minutes of Lake Elmo Council Meeting May 7, 1974 Page 2 Park Bond C. Abercrombie offered Resolution R74-13 ordering referendum Issue on proposed park 1974 bond issue. Second by C. Brookman Resolution R-74-13: carried 4 - 0, C. Shervheim absent, Lake Elmo Bldg. Insp, advised that he had issued a demolition order on the Heights: old house on Lake Elmo Heights property. Mortgage holder stopped any further demolition. Counsel instructed to draw up order for action at next council meeting. Bldg. Insp. to confer with Counsel as a couple of other buildings are in need of demolition. White Adv: White Adv. reconstructed a sign on Hwy. 12 which was damaged by high winds. Motion by C. Abercrombie second by C. Brookman ordering Counsel to write White Adv. instructing them to remove sign and enjoin them from installing new sign and also order removal of trash left after illegal reconstruction. Carried 4 - 0. Don Olson Motion by C. Shervheim second by C. Brookman to issue Special SUP: Use Permit to Don Olson allowing construction of a 42" Chain link fence on his property on Legion Ave. Carried 5 - 0. i Home Rule Mayor Eder turned meeting over to acting Mayor Abercrombie. Charter: Mayor Eder expressed his opinion of the Home Rule Charter and then offered Motion to support petition to establish a charter commission with the village council to participate in selection of nominees to commission. Second by C. Shervheim. Each councilmen expressed his views before vote was taken, Vote was 1 in favor 1 against and 3 abstentions. Aye - Mayor Eder, Naye C. Shervheim- Motion failed. Mr. Brandon and Mr. Hedges joined council table. After much discussion regarding a charter commission or a study committee it was agreed to come to the next meeting May 21, 1974 prepared to offer names for either a study committee or a charter commission. Tri-Lakes Clerk instructed to include this on agenda for meeting May 21, 1974. Sewer Report: Claims: Motion by C. Abercrombie second by C. Brookman to authorize clerk to pay claims 74207 thru 74239. Carried 5 - 0. Gas Insp. Question raised as to whether or not Roy Dornfeld is still acting as gas inspector. No claims filed in 1973 and thru April 1974. Mayor Eder will resolve. Beer License: 1, 3M r uests that license presently held be modified to include distribu�on of beer from sports building located adjacent to new ballfields. Minutes of Lake Elmo Council Meeting May 7, 1974 Page 3 2. Volunteer Firemen requested one day license for June 28, 1974 at annual street dance. Motion by C. Abercrombie second by C. Shervheim to approve both requests listed above. Carried 5 - 0. Lundholm- Clerk advised that Gordon Lundholm inquired as to availability Water: of village water and if available cost of installation. Motion by C. Brookman second by C. Shervheim to approve installation subject to Mr. Lundholm signing a contract obligating him or land title holder to pro -rated assessment when service is extended in front of property. Mr. Lundholm would also be required to pay all installation costs. Carried 5 - 0. Revenue Motion by C. Shervheim second by C. Brookman to use Revenue Sharing: Sharing, Entitlement #5 ($15,348.00) as follows: $5,700 for Firemen's Relief Ass'n obligation and the balance for parks and park development. Carried 5 - 0. Employee Motion by C. Shervheim second by C. Abercrombie that the following Time off.: be adopted as part of the employee benefits and regulations: Employee absences from work ,with proper notice, shall not result in reduction in salary if the absence is due to 1. Vacations property scheduled and accrued according to the approved formula, 2. Sick days due to bonafide illness of the employee, within the limits of time accumulated under the approved formula. 3. Holidays listed in thq approved schedule. 1 4. Up to one day to attend the funeral of a member of the immediate family of the employee (father, mother, brother, sister, spouse, son or daughter). Personal time off for other purposes (other funerals, personal court appearances, etc.) may, at the option of the employee, be charged against vacation time or may be made up by productive work after hours or on weekends, or may result in a reduction in salary due to hours missed, provided that in all such cases, the employee shall have obtained the advance approval of the Councilman in charge, who shall also have authority to make exceptions to these rules when in his judgment the basic policy herein announced will not be violated and when the precedent set by such exception will not be damaging in handling future similar requests. Resolution C. Abercrombie presented Resolution R74-14 Observing National R74-14: Police Week and ask council confirmation. C. Brookman made second. Resolution passed 5 - 0. Ballfield The ball park, opposite the Village fire hall, is used by various Use Rates: groups who have reserved the park at the Village office in advance. The usual charges for use of the park for events which are open to the public without charge are asfollows: 1. Per day (including lights if use is continued into the evening). $12.50 Minutes of the Lake Elmo Village Council Meeting May 7, 1974 Page 4 2, Evening games scheduled under the lights, $10.00 3. Tournament games extending two days (includes use of lights) $18.00 4. Tournament games extending three days (includes use of lights) $24.00 5. Regular sponsored home teams per evening under the lights $5.00 Regular fees may be waived at the discretion of Councilman in charge for such sponsored groups as Cub Scouts Boy Scouts Bluebirds Campfire Girls Etc. Since Lake Elmo's park facilities are maintained at the expense of, and for the benefit of, Lake Elmo's citizens, it shall be the policy of the Village to discourage groups who would rent our ball park facilities, fence them off and charge our citizens an admission fee for money -making purposes. Since certain of these groups do, however, serve our citizens in a variety of ways, it shall be the re ponsibility of the Councilman in charge of parks to determine a grant permission for such use in each such case. The usual fee for this type of use will be 25% of the gross on all admissions charged and 15% of the gross on all concessions (pop, popcorn, beer, etc.) A $100.00 advance deposit shall usually be required, and a full accounting shall be delivered to the Village office within two days following the event with full payment of any balance due. The Councilman in charge of parks shall have discretion to modify these fees if in his judgment the event is beneficial to the Lake Elmo citizens generally. Adjournment: Motion by C.
