Minutes of Lake Elmo Village Council Meeting <br />June 4, 1974 Page 1 <br />Called to order at 7:32 p.m, by Mayor Eder. <br />Present: Eder, Abercrombie, Shervheim, Pott and Brookman <br />Also Present: Assessor Park, Counsel Raleigh, Engineer Bonestroo, Bldg. Insp. <br />Mueller and PZC members Johnson, Lyons and Williams. <br />Minutes Approval:Mot4on_r-by C. Shervheim second by C. Brookman to approve minutes <br />of May 21, 1974 meeting as submitted. <br />Carried 5 - 0. <br />Springborn S.U.P:Motion by C. Shervheim second by C. Abercrombie to approve <br />special use permit based on recommendation of PZC for special uses. <br />See PZC minutes of May 28, 1974. <br />32nd St. Clerk read petition submitted by a number of residents from 32nd <br />Traffic: St. N. requesting that council give up thoughts of banning parking <br />on that st. They also offered possible substitutes. <br />Motion by C. Brookman second by C. Abercrombie that 32nd St, N. be <br />made a one way street West to East between Klondike and Lake Elmo Ave. <br />Also that we attempt to get reduced speed on this stretch of road. <br />This will start as soon as signs and approval from state on speed <br />limit can be obtained. It will be evaluated at the end of 6 months <br />to determine if this is effective. <br />Carried 5 - 0. <br />Resolution Resolution R74-16 establishing a 20 mph speed limit submitted by <br />R74-16: C. Abercrombie second by C. Shervheim, <br />Carried 5 - 0. <br />Francis Downs Motion by C. Brookman second by C. Shervheim approving a S.U.P. <br />S.U.P.: fora swimming pool for Francis Downs 3759 Jamaca Ave. N. according <br />to recommendations of PZC.. Motion carried 5 - 0. <br />Richert Mining Fred Richert represented by his sons Elmer and Wilbur Richert. <br />Permit: <br />Barton Construction agreed with Mayor Eder and C. Brookman that they <br />would correct problems left previously. They would level area - <br />slope drainage to NW and restore as per 1972 agreement. <br />Bruce Folz representing Richert showed map of 40 acres involved. <br />Estimated fill material 1 to 200,000 yds. Possible time limit 3-4 <br />years. Fill would be moved from property on the North edge of property. <br />Sheldon Caswell, attorney representing surrounding residents, requested <br />that Mayor Eder step down and not to vote on issue since, at the <br />May 14, 1974 PZC meeting, his actions were interpreted that he was <br />an agent for Mr. Richert. <br />( Sheldon Caswell stated that at the May 14, 1974 PZC meeting the <br />Richert issue was heard. He stated matter was tabled and was <br />informed it would not be brought up again. Application in violation <br />of ordinance which requires restoration of top soil since it stated <br />no top soil would be replaced. <br />
