R-74-17 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION OF THE CITY OF LAKE ELMO OPPOSING THE CREATION OF THE <br />PROPOSED BATTLE CREEK WATERSHED DISTRICT, ANOKA ,RAMSEY AND <br />WASHINGTON COUNTIES. <br />Member, R.BRuce Abercrombie, introduced the following Resolution and <br />moved its adoption. <br />RESOLUTION <br />WHEREAS, the Division of Waters, Soils and Minerals of the <br />Minnesota Water Resources Board has received two nominatinS-petitions <br />for the establishment of a watershed district to be known as the <br />Battle Creek Watershed District which would include land lying within <br />the City of Lake Elmo, Washington County, Minnesota, and <br />WHEREAS,the Minnesota Water Resources Board, pursuant to due <br />notice, has set a hearing for Thursday June 13,1974 at 10:00a.m. for <br />the purpose of reviewing testimony as to the establishment of said <br />watershed district, and <br />WHEREAS,the City Council of the -City of Lake Elmo is strongly <br />and unanimously opposed to the establishing of the proposed watershed <br />district for the following reasons, to -wit: <br />l.Said petitions were submitted to the Water Resources Board <br />without the knowledge or consent of or consultation with the City of <br />Lake Elmo or apparently a large majority o-fthe-minicipalities lying <br />within the proposed watershed district. <br />2.Said proposed watershed district includes a vast area extending <br />over three counties, 17 municipalities and consisting of 86.8 sq.miles. <br />3.Said proposed watershed district includes at least four sep- <br />arate and hydrologically defined watersheds, to -wit Battle Creek,Fish <br />Creek, Phalen Lake and Beaver Lake; each with its own separate and <br />independent water control problems. <br />4.The procedures set forth in Chapter 112 of Minnesota Statutes, <br />The Minnesota Watershed Act, by definition,.provide the opportunity <br />for affected communities to have a voice in the -fixing -of the bound- <br />aries of a proposed watershed district,in determining the managers of <br />said district, and in resolving water control problems; that by rea- <br />son of the size and number of communities involved in the proposed <br />Battle Creek Watershed District, the opportunity for local input into <br />the organization, control and management of the proposed watershed is <br />non-existant. <br />5.That because of the vast size and population of the proposed <br />watershed district the procedures required by the Minnesota Watershed <br />Act for the implementation of any project or improvement within the <br />district would be largely unworkable, cumbersome and time consuming; <br />likewise the procedure.de.termination of benefits and damages to each <br />parcel affected by a proposed project would be largely unworkable, <br />cumbersome and time consuming by reason of the vast area and popula- <br />tion of the proposed district. <br />
