R-74-17 <br />6.That in order for a proposed watershed district to be effective <br />all affected municipalities must endorse the creation of such a dis- <br />trict, that to date only the City of St. Paul, the Ramsey County Board <br />of Commissioners,and a small group of property owners have endorsed <br />the proposeddistrict. Without the complete cooperation of the various <br />units of government, the proposed watershed district will be unable <br />to perform a useful function. <br />7.That under the present taxing procedures of the current Minnesota <br />Watershed Act, individual communities would be generally assessed for <br />improvements totally outside the boundaries of said community. <br />8.That the present water control problem of the present hydrolog- <br />ically defined Battle Creek Watershed District, which includes only <br />municipalities of Woodbury, Lake Elmo, Oakdale, Maplewood and St. Paul, <br />are those of control of present conditions and not of planning so as to <br />prevent future conditions; that said water control problems could best <br />be resolved by either a Joint Powers Agreement or in the alternative <br />a watershed district of said affected communities. <br />NOW, THEREFORE BE IT RESOLVED between the City Council of the City <br />of Lake Elmo, Washington County, Minnesota, that the Minnesota -Water <br />Resources Board dismiss the nominating petition for the establishment <br />of the Battle Creek Watershed District by reason of the above set .forth <br />paragraphs 1 through 8, and by reason of the fact that -the proposed <br />district is not in the interest of public health; in that it will not <br />tend to improve the general sanitary conditions of the proposed district <br />as a whole; that it is not in the interest of public welfare; in that <br />it will not tend toimprove, benefit, or contribute to the safety or <br />well-being of the general public or benefit its inhabitants of the City <br />of Lake Elmo; and that it will not serve the purpose of the Minnesota <br />Watershed Act. <br />Passed by the City Council of the City of Lake Elmo this 4th day <br />of June, 1974. <br />Attest: <br />�._ <br />The motion for the adoption of the forgoing Resoluti,on:.was- <br />seconded by member Francis Pott and upon a vote being taken all <br />voted in favor thereof. <br />
