MINUTES OF THE LAKE ELMO CITY COUNCIL MEETING JANUARY 21, 1975 pg. 2 Mayor recessed meeting at 6:53 PM for supper. Mayor reconvened the council meeting at 8:40 PM. Lang Vacation:Councilman Abercrombie moved that the Lang property (Lots 669 thru 672) be vacated for the reasons discussed and that counsel draw up Resolution R75-4 for review and approval at the next meeting. Carried 5-0. Richert Mining Permit:Mr. Rudy represented Shafer Contracting, who is the company that will actually do the mining, and Elmer Richert represented Fred & Lydia Richert. Mr. Rudy expressed desire to renew the gravel mining special use permit which expired November 1, 1974. There is approx. 100,000 yds of material they would like to be able to move over the next two years. Shafer has permission to use the access road across private property to the South. Gate would be installed at the access point and road would be dust treated. Decision tabled until February 4, 1975 meeting at which time landowners within 300 feet of site will be invited to participate in discussion. 9:00 PM. Animal Control:Clerk instructed to investigate other possibilities than B & E for animal control. One suggestion was Bob Connally, formerly of the Stillwater Police Dept., who may now be servicing Baport and/or Stillwater. Appointments: Motion by Councilman Shervheim 2nd by Councilman Pott to approve the following appointments: Weed Inspectors M.Eder, E. Richert & R. Wier Depository State Bank of Lake Elmo Bonding Agent Juran & Moody Alternate Mayor R.B.Abercrombie Civil Defense Donal Olson Counsel Lawson, Ranum & Raleigh Health Inspector Dr. Van Meier, mayor & clerk Official Publication Stillwater Daily Gazette Motion carried 5-0. 3 appointments remain to be resolved; they are,Engineer, Insurance Committee & Animal Control. Engineer: Motion by Councilman Pott 2nd by Councilman Shervheim that matter of Engineering Consultant be brought back before the council for further discussion. Carried 5-0. Discussion ensued as to whether or not a possible-confli-ct-of-interest - exists, particularly with the city council's need to independently evaluate local sewer systems in context of the much broader Metro Sewer Systems Study now being undertaken at the direction and expense of the Waste Control Commission by the Engineering Firm of Bonestroo, Rosene, Anderlik & Assoc.. Mayor requested that council be polled on the original motion. Mayor Eder, Councilman Abercrombie, Councilwoman Lyons & Councilman Pott in favor. Councilman Shervheim against. Carried 4-1. Mayor suggested that councilmembers consider possible consulting firms to be interviewed and be ready to discuss at the council meeting February 4, 1975.
