MINUTES OF THE LAKE ELMO CITY COUNCIL MEETING FEBRUARY 18, 1975 pg. 1 <br />Meeting called to order at 7:32 PM by Mayor Eder. <br />Present: Mayor Eder, Councilmen Abercrombie & Pott & Councilwoman Lyons (7:48 PM) <br />Absent: Councilman Shervheim. <br />Also present:Counsel Raleigh, Fiscal Agents Representative Steve Mattson and PZC <br />Member Williams. <br />Minutes: Motion by Councilman Abercrombie 2nd by Councilman Pott to approve the <br />minutes of the February 4, 1975 meeting as submitted. Carried 3-0. <br />Councilman Shervheim and Councilwoman Lyons not present. <br />Motion by Councilman Pott 2nd by Councilman Abercrombie to approve the <br />minutes of the Special Council Meeting of February 12, 1975 as submitted. <br />Carried 3-0. <br />Kraft Circle:Councilman Pott explained that Kraft Circle roadbed is not properly <br />pitched and each spring thaw and summer rain results in excess pooling <br />of water on the Burton property. Councilman Pott requested that council <br />approve an engineering study and recommendation on what can be done to <br />correct the problem. <br />Motion by Councilman Pott 2nd by Councilman Abercrombie to authorize <br />the engineer to study the problem with excess water on Kraft Circle <br />and make a recommendation on what con be done to resolve this problem. <br />Carried 3-0. <br />Park Bond: Steve Mattson of Juran & Moody suggested that Lake Elmo consider Ad- <br />vance Refunding on the $739,000 Park Bond. The present market conditions <br />are such that Lake Elmo could realize a saving of $36,000 to $64,000 <br />or possibly more depending on how the Advance Refunding is set up. <br />Mr. Mattson was instructed to set up a new schedule based on a semi-annual <br />redemption (March & September) beginning in 1976 rather than 1977. <br />New schedule to be available in a week so council has about a week to <br />review it. A representative of Juran & Moody will attend the March 4, <br />1975 meeting to answer any questions and assist the council in <br />reaching a decision. <br />1974 Financial Report: Marilyn Banister (Lake Elmo City Office Bookkeeper) assisted <br />clerk in answering questions relative to the 1974 financial report. <br />Motion by Councilman Pott 2nd by Councilman Abercrombie to approve the <br />1974 financial report as submitted. Carried 4-0. <br />Police Protection:Mayor advised that the Police Study Committee would make a new <br />appraisal of our needs and make a recommendation to the council at <br />the meeting March 4, 1975. Sheriff Westphal advised that we must antic- <br />ipate our needs and give him sufficient lead time to have an officer <br />available. Norman L.Lyall to be included on March 4, 1975 agenda to <br />discuss matter. <br />Conflict of Interest:Counsel Raleigh advised there is no clear cut rule relative <br />to conflict as it applies to a member of a governing body sitting in <br />on a decision that affects his full time employer. Unless he benefits <br />directly from the decision then there is probably no conflict. Counsel <br />to review matter further. <br />
