R-75-/O <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION OPPOSING ENACTMENT BY THE STATE LEGISLATURE <br />OF ANY LAW PURPORTING TO REQUIRE THE CONSTRUCTION OF <br />PROPOSED HIGHWAY I-94 ON THE RIGHT-OF-WAY OF EXISTING U.S. <br />HIGHWAY 12 <br />WHEREAS, the City of Lake Elmo has, since 1967, maintained a Comprehensive Plan <br />for development of the City based on the plans of the Minnesota Highway Department <br />for construction of I-94 midway between existing U. S. Highway 12 and Tenth Street <br />North (formerly Minnehaha Avenue) in the City of Lake Elmo; and <br />WHEREAS, the City Council of the City of Lake Elmo has heretofore approved <br />the location of the proposed I-94 midway between existing U. S. Highway 12 and <br />Tenth Street North (hereinafter the "Northern Route") for a number of reasons set <br />forth in the Resolution approving the same; and <br />WHEREAS, extensive study of the proposed route for said highway has been con- <br />ducted by the so-called "I-94 Management Committee" composed of persons representing <br />Washington County and Towns and Cities affected by the proposed construction as well <br />as citizen representatives from the various communities; and <br />WHEREAS, the study conducted by said Management Committee involved extensive <br />hearings at which proponents and opponents of the various routes proposed for the <br />highway were given an opportunity to be heard; and <br />WHEREAS, the recommendations of that committee expected within the next several <br />weeks will be submitted to the Minnesota State Highway Department to serve as a basis <br />for its ultimate decision on the proper location of the highway; and <br />WHEREAS, it is the considered opinion of this City Council that the Minnesota <br />State Highway Department with its expertise and with the advice and recommendations <br />of the said Management Committee established for that purpose is best qualified to <br />select the most desirable route for the location of the proposed highway I--94; and <br />WHEREAS, it is the considered opinion of this Council that the State Legislature <br />and its committees are not the proper forum for deciding on specific location of high- <br />ways and that it would be establishing an undesirable precedent for the Legislature <br />to enact such a law: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo that <br />the Legislature is hereby urged to refrain from enacting such legislation and each <br />Legislator is hereby urged to vote against either House File No. 61 or Senate File <br />No. 1220 or any similar bill relating to the specific location of proposed I-94. <br />BE IT FURTHER RESOLVED, that copies of this Resolution be delivered forthwith to <br />those State Legislators whose districts include part of Washington County. <br />Adopted by the City Council this 6th day of May, 1975. <br />—14 a d L .
