R-75-/O RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION OPPOSING ENACTMENT BY THE STATE LEGISLATURE OF ANY LAW PURPORTING TO REQUIRE THE CONSTRUCTION OF PROPOSED HIGHWAY I-94 ON THE RIGHT-OF-WAY OF EXISTING U.S. HIGHWAY 12 WHEREAS, the City of Lake Elmo has, since 1967, maintained a Comprehensive Plan for development of the City based on the plans of the Minnesota Highway Department for construction of I-94 midway between existing U. S. Highway 12 and Tenth Street North (formerly Minnehaha Avenue) in the City of Lake Elmo; and WHEREAS, the City Council of the City of Lake Elmo has heretofore approved the location of the proposed I-94 midway between existing U. S. Highway 12 and Tenth Street North (hereinafter the "Northern Route") for a number of reasons set forth in the Resolution approving the same; and WHEREAS, extensive study of the proposed route for said highway has been con- ducted by the so-called "I-94 Management Committee" composed of persons representing Washington County and Towns and Cities affected by the proposed construction as well as citizen representatives from the various communities; and WHEREAS, the study conducted by said Management Committee involved extensive hearings at which proponents and opponents of the various routes proposed for the highway were given an opportunity to be heard; and WHEREAS, the recommendations of that committee expected within the next several weeks will be submitted to the Minnesota State Highway Department to serve as a basis for its ultimate decision on the proper location of the highway; and WHEREAS, it is the considered opinion of this City Council that the Minnesota State Highway Department with its expertise and with the advice and recommendations of the said Management Committee established for that purpose is best qualified to select the most desirable route for the location of the proposed highway I--94; and WHEREAS, it is the considered opinion of this Council that the State Legislature and its committees are not the proper forum for deciding on specific location of high- ways and that it would be establishing an undesirable precedent for the Legislature to enact such a law: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo that the Legislature is hereby urged to refrain from enacting such legislation and each Legislator is hereby urged to vote against either House File No. 61 or Senate File No. 1220 or any similar bill relating to the specific location of proposed I-94. BE IT FURTHER RESOLVED, that copies of this Resolution be delivered forthwith to those State Legislators whose districts include part of Washington County.
