R-75-25 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ORDERING SURFACE WATER CONTROL <br />PROJECT NO. I AND APPROVING THE PLANS THEREFOR <br />WHEREAS, a resolution of the City Council adopted July 2nd, 1975, <br />fixed a date for the Council hearing on the proposed Surface Water <br />Control Project I; and, <br />WHEREAS, notice of said hearing was given as required by law and <br />the hearing was held on July 15, 1975, at which time all persons de- <br />siring to be heard were given an opportunity to be heard thereon: <br />NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Lake <br />Elmo, as follows: <br />1. Such improvement as proposed in the Council's Resolution adopted <br />July 2nd, 1975, is hereby ordered, in part, as hereinafter described - <br />to -wit: <br />(a) Said project shall include temporary pumping for emergency <br />purposes only. That is to say - said pumping shall be carried on <br />constantly, if necessary, but only as needed in the opinion of the City <br />Engineer to prevent flood damage or health hazards. The City Engineer <br />in determining the necessity of such pumping shall consider the risk of <br />such damage or health hazards both upstream and downstream from the <br />pumping areas. The pumping areas shall be from Lake Jane to the City <br />Park property upstream of Sunfish Lake. <br />All such pumping shall terminate when the risk of such <br />flood damage or health hazard has subsided or September 15, 1975, which- <br />ever date is earlier. <br />(b) Said project shall include construction of conduit and ditch <br />from Deerpond to Lake Jane to carry the overflow from Lake Olson to Lake <br />Jane. <br />(c) Said project shall include surveillance of Eagle Point Lake <br />and Sections 13 and 24 for possible possible problems and temporary <br />emergency pumping if necessary under the same limitations and conditions <br />as set forth under paragraph (a), above. <br />(d) Said project <br />adding of culverts where <br />surveillance. <br />(e) Said project <br />flood control within the <br />fish Lake to its original <br />control has terminated. <br />shall include the clearing, replacing,or <br />needed in any of the areas of such pumping or <br />shall include the return of any land used for <br />area from DeMontreville Highlands through Sun - <br />condition, after the use of such land for flood <br />2. The City Engineers, Bonestroo, Rosene, Anderlik and Associates, <br />Inc. are hereby designated as the engineers for this improvement.
