MINUTES OF THE LAKE ELMO CITY COUNCIL MEETING, February 3, 1976. <br />Meeting called to order at 7:34p.m. by Mayor Eder. <br />Present: Mayor Eder, Councilman Abercrombie, Shervheim and Pott and <br />Councilwoman Lyons. <br />Also present: Engineer Noyes. <br />31i-EIS ---- Councilman Abercrombie advised that the revised draft had <br />been submitted to the Metro Council and they have responded. <br />Meetings on the EIS have been scheduled for March 29 and <br />March 30 at Oakdale City Hall and April 5 and April 6 in <br />Stillwater,exact time and location to be set. One meeting <br />at each location will be in the afternoon and one will be <br />in the evening. <br />Terry Emerson: Request variance to bring a house, over 10 years old, <br />into Lake Elmo since this violated section 504.190 of the <br />Municipal Code adopted June 4, 1974. Counsel and Planner <br />recommend change of code. Motion by Councilman Shervheim <br />2nd by Councilman Abercrombie to grant variance on an inter- <br />im basis subject to conditions defined by the building <br />inspector in his letter of January 27, 1976 to city council. <br />Counsel to prepare interim variance showing owners intent <br />to comply with code and all conditions specified. Carried <br />5-0. Motion by Councilman Shervheim 2nd by Councilwoman <br />Lyons authorizing counsel and planner to review and submit <br />changes putting in more reasonable regulations including <br />that house be compatable with area and meet all the require- <br />ments of the building code. Carried 5-0. <br />Comprehensive Plan: Councilwoman Lyons offered Resolution R76-4, <br />a resolution receiving recommended comprehensive plan <br />provision from the City Planning Commission and forwarding <br />same to Metropolitan Council. 2nd by Councilman Pott. <br />Carried 5-0. <br />Demontreville Highlands: Meeting held Saturday, January 31, 1976 <br />with Councilman Shervheim, Counsel Raleigh, Park Committee <br />Chairman, Morgan, Mr. Derrick and Mr. Gottsacker to discuss <br />subject develop -lent. Agreement was reached to reduce size <br />of park acquisition so that land can be acquired within the <br />limits of the original bond budget. Copy of Memorandum from <br />Midwest Planning dated January 27, 1976 should be made a part <br />of the minutes of the January 20, 1976 Council Meeting. <br />Minutes ---Page 1-Comprehensive Plan --Delete name Johnson after PZC <br />chairman. <br />Motion by Councilwoman Lyons 2nd by Councilman Pott to <br />approve minutes of January 20, 1976 meeting as amended. <br />Carried 5-0. <br />Shafer Contracting: Counsel advised that, in his opinion, there is <br />no way the Special Use Permit for operation of the Richert <br />Pit could be construed as permitting any expansion of activity. <br />Mayor and clerk directed to write Mr. Rudy and advise him <br />that his request to process 25,000 cu. yds of class 5 gravel <br />has been denied. <br />
