MINUTES OF LAKE ELMO CITY COUNCIL MEETING — MAY 18, 1976 Meeting called to order at 5:05 P.M. by acting Mayor Abercrombie. Present: Councilmen Abercrombie, Shervheim (7:42) and Pott and Councilwoman Lyons. Absent: Mayor Eder Also Present: Assessor Park, Counsel Raleigh (5:30) Building Inspector Mueller (5:35) and Engineer Noyes. Board of Review: Assessor Park explained and distributed copies of the new legislation. Meeting on Friday May 21, 1976 of Board of Review is to hear comments and answer questions on 1976 evaluations (this will be used to determine taxes payable in 1977). Bill advised that Tri—Lakes held a tax or evaluation protest meeting of their own on May 17, 1976. Scheel and Burns of Assessor's office have reduced some land values but this is after current increases had been applied. That is, lake shore lots increased from $9,000 to $12,500. Board of Review requires three members of the Council present for full hearing (9 A.M.-3 P.M.) Flood Control Report: Tom Noyes advised that the current lake levels are as follows: Jane 922.54 Park Pond 900.5 Sunfish 892.68 Elmo 885.81 Eagle Point 895.59 Olson 929.63 (1" below Wier) Long 938.41 (about 6" still flowing) To date have pumped 130 acre feet. Pumping at rate of 2200 gals./minute. Anticipate end of first 360 hrs. (appros. 150 acre feet) and shut down of pumps on Thursday. Noise of pumps is still a problem. Suggestions to Engineer Noyes to look into cost of electric pump. Councilman Pott offered a resolution to restate our position and advise VBWD that they, by charter authority to assume responsibility of project. Resolution failed for lack of a 2nd. Valley Branch Watershed District hearing, Wednesday May 26, 1976, 8:00 P.M. Lake Elmo Elementary School. Recess at 6:30 — Reconvened at 7:42 P.M. Septic Systems: Engineer and counsel to prepare report of septic tanks constructed below level required by ordinance. Motion by Councilman Shervheim, 2nd by Councilwoman Lyons authorizing counsel to prepare letter to those in violation of ordinance allowing 30 days for owners to apply for permit or variance. Violations would be based on 928 level on Lake Jane. Carried 4-0 Mayor Eder Absent. Park Committee: Motion by Councilman Shervheim 2nd by Councilman Pott to approve expenditure of up to $700 to complete fencing around Sunfish Park. Carried 4-0. Motion by Councilman Shervheim 2nd by Councilman Pott to approve estimated expenditure of up to $300 for grass seed to be planted to prevent erosion. Carried 4-0. Jess Mottaz and Don Dau have been lost to Park Advisory Committee, Chairman Morgan requested appointment of Bill Osborn to fill one of the vacancies. Motion by Councilman Shervheim 2nd by Councilman Pott to approve appointment of Bill Osborn to Park Advisory Committee. Carried 4-0.
