MINUTES OF LAKE ELMO CITY COUNCIL MEETING — MAY 18, 1976 <br />Meeting called to order at 5:05 P.M. by acting Mayor Abercrombie. <br />Present: Councilmen Abercrombie, Shervheim (7:42) and Pott and Councilwoman Lyons. <br />Absent: Mayor Eder <br />Also Present: Assessor Park, Counsel Raleigh (5:30) Building Inspector Mueller (5:35) <br />and Engineer Noyes. <br />Board of Review: Assessor Park explained and distributed copies of the new legislation. <br />Meeting on Friday May 21, 1976 of Board of Review is to hear comments and <br />answer questions on 1976 evaluations (this will be used to determine taxes <br />payable in 1977). Bill advised that Tri—Lakes held a tax or evaluation protest <br />meeting of their own on May 17, 1976. Scheel and Burns of Assessor's office <br />have reduced some land values but this is after current increases had been <br />applied. That is, lake shore lots increased from $9,000 to $12,500. Board <br />of Review requires three members of the Council present for full hearing <br />(9 A.M.-3 P.M.) <br />Flood Control Report: Tom Noyes advised that the current lake levels are as follows: <br />Jane 922.54 Park Pond 900.5 <br />Sunfish 892.68 Elmo 885.81 <br />Eagle Point 895.59 Olson 929.63 (1" below Wier) <br />Long 938.41 (about 6" still flowing) <br />To date have pumped 130 acre feet. Pumping at rate of 2200 gals./minute. <br />Anticipate end of first 360 hrs. (appros. 150 acre feet) and shut down of <br />pumps on Thursday. Noise of pumps is still a problem. Suggestions to <br />Engineer Noyes to look into cost of electric pump. Councilman Pott offered <br />a resolution to restate our position and advise VBWD that they, by charter <br />authority to assume responsibility of project. Resolution failed for lack <br />of a 2nd. <br />Valley Branch Watershed District hearing, Wednesday May 26, 1976, 8:00 P.M. <br />Lake Elmo Elementary School. <br />Recess at 6:30 — Reconvened at 7:42 P.M. <br />Septic Systems: Engineer and counsel to prepare report of septic tanks constructed <br />below level required by ordinance. <br />Motion by Councilman Shervheim, 2nd by Councilwoman Lyons authorizing <br />counsel to prepare letter to those in violation of ordinance allowing <br />30 days for owners to apply for permit or variance. Violations would be <br />based on 928 level on Lake Jane. Carried 4-0 Mayor Eder Absent. <br />Park Committee: Motion by Councilman Shervheim 2nd by Councilman Pott to approve <br />expenditure of up to $700 to complete fencing around Sunfish Park. <br />Carried 4-0. <br />Motion by Councilman Shervheim 2nd by Councilman Pott to approve estimated <br />expenditure of up to $300 for grass seed to be planted to prevent erosion. <br />Carried 4-0. <br />Jess Mottaz and Don Dau have been lost to Park Advisory Committee, Chairman <br />Morgan requested appointment of Bill Osborn to fill one of the vacancies. <br />Motion by Councilman Shervheim 2nd by Councilman Pott to approve appointment <br />of Bill Osborn to Park Advisory Committee. <br />Carried 4-0. <br />
