R-76 - R 7 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION DIRECTED TO THE WASHINGTON COUNTY <br />BOARD OF COMMISSIONERS RELATING TO LAKE ELMO <br />METROPOLITAN PARK <br />WHEREAS, the City Council of the City of Lake Elmo has on a <br />number of prior occasions passed resolutions memorializing its <br />approval of the establishment of the said Lake Elmo Metropolitan <br />Park, with certain qualifications and conditions; and <br />WHEREAS, copies of such resolution - namely: <br />Resolution 70-5 adopted March 3, 1970 <br />Resolution 71-14 adopted August 3, 1971 <br />Resolution 74-22 adopted July 16, 1974 <br />Resolution 74-35 adopted November 19, 1974, <br />are annexed hereto and made a part hereof; and <br />WHEREAS, the City Council of the City of Lake Elmo has supported the <br />acquisition of said Lake Elmo Regional Park with the understanding that <br />park boundaries were fixed by the plans approved in the City's prior <br />resolutions; and <br />WHEREAS, the City of Lake Elmo has recently adopted a Comprehensive <br />Plan based on the belief and understanding that the boundaries of said <br />park were so fixed; and <br />WHEREAS, the City Council of the City Of Lake Elmo has recently <br />become aware that the County is negotiating for the acquisition of <br />certain lands owned by Elwood W. Mears in the City of Lake Elmo which <br />lands were not included within the boundaries of the proposed Lake Elmo <br />Regional Park as previously approved by the City Council; and <br />WHEREAS, the Lake Elmo City Planner has reviewed the present pro- <br />posed acquisition and in his report to this Council dated September 20, <br />1976, recommended that the lands now owned by Elwood Mears be excluded <br />from said Regional Park for various reasons stated in that report; and <br />WHEREAS, the City Council determines that the reasons set forth in <br />said report by the City Planner are of immediate and critical concern to <br />the City; and <br />WHEREAS, the City Council has determined that the proposed acquisition <br />of all of the Mears land as part of the Lake Elmo Regional Park is beyond <br />the scope of the prior approvals granted by this City; and <br />WHEREAS, the City Council has determined that it would be detrimental <br />to the interests of the City of Lake Elmo for the said lands owned by <br />Elwood Mears to be acquired as part of the Lake Elmo Regional Park: <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of <br />Lake Elmo as follows: <br />
