R-76-20 <br />maintenance of public utilities and provision of <br />other public services for any legitimate public <br />purpose. <br />(c) That all of said Owners agree among themselves to <br />participate in the cost of maintenance of said <br />private roadway on a pro rata basis and agree to <br />maintain the same suitable for use by fire and <br />other emergency vehicles and acknowledge that <br />the City shall have no responsibility whatsoever <br />for the maintenance of such private roadway. <br />(d) That the Owners agree to grant to the City an <br />option to acquire the land used for said private <br />roadway to a width of sixty-six (66) feet, with- <br />out cost, in the event the City Council or its <br />successor should at any time determine that it is <br />necessary and in the public interest to construct <br />a private road thereon. The instrument granting <br />said option, shall, also, be executed by each of <br />the said owners and delivered to the City for <br />recording in the office of the Register of Deeds <br />at the same tisna as said proposed plat is endorsed <br />with the approval of City_ <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City <br />of Lake Elmo that the minor subdivision sought by the applicants as <br />described above and set forth in the Clerk's file herein is hereby <br />approved subject to the following conditions: <br />1. The said applicants shall execute a development agreement <br />with the City, in a form satisfactory to the City Attorney, binding <br />each of the applicants to perform all of the conditions of approval <br />as set forth above. <br />2. Said applicants shall grant each to the other and to the <br />City of Lake Elmo such easements as may be necessary to effectuate <br />the agreements set forth above. <br />Passed by the City Council of the City of Lake Elmo, this 6th <br />day of July, 1976. <br />Attest: Mayna. d L.
