WHEREAS, it appears to the City Council of the City of Lake <br />Elmo that immediate emergency action is necessary to remove the <br />contaminated flood water from the Jamaca Court area, and to lower <br />the level of Lake Elmo; and <br />WHEREAS, it appears to the City Council that it may be <br />necessary and appropriate to take other emergency action to pre- <br />vent substantial flood damage and to preserve public and private <br />property in other parts of the City of Lake Elmo and to avoid <br />health hazards which may result from the flooding of individual <br />sewage disposal systems; and <br />WHEREAS, the City Council of the City of Lake Elmo has, before <br />this date, determined that the problem of control of flood waters <br />and the prevention of damage from flood waters is, to a large <br />extent, beyond the jurisdiction and responsibility of the City of <br />Lake Elmo and that the Valley Branch Watershed District has both <br />the power and authority to deal with these matters: <br />NOW, THEREFORE, BE IT RESOLVED, by. the City Council of the <br />City of Lake Elmo as follows: <br />1. That the City Council by this Resolution, requests <br />immediate emergency action by the Valley Branch Watershed District <br />to abate the flood conditions in the Jamaca Court area and in <br />the area surrounding Lake Elmo Lake. <br />2. The City Council suggests that the appropriate temporary <br />action in the Jamaca Court area would be to install pumping <br />equipment to move the water to Eagel Point Fork or, to replace <br />the existing culvert so that the flood waters will drain by <br />gravity into the Eagle Point Fork waterway. <br />3. That the City Council suggests that appropriate emergency <br />action to reduce the level of Lake Elmo Lake would be to sand bag <br />the outlet of Eagle Point Lake so as to retain more water and <br />slow the flow to Lake Elmo Lake. <br />4. The Valley Branch Watershed District and the_ State <br />Department of Natural Resources are hereby notified that the City <br />of Lake Elmo considers the suggested temporary emergency action <br />to be a minimum necessary to protect the health and safety of the <br />Lake Elmo residents within the Jamaca Court area and in the area <br />surrounding Lake Elmo Lake and for that reason it is the City <br />Council's present intention to take such temporary action to <br />protect the public in the event the Valley Branch Watershed <br />District fails to. If it becomes necessary for the City to take <br />such action the consent and financial assistance of the Valley <br />Branch Watershed District and the consent and assistance of the <br />Department of Natural Resources is hereby requested. <br />
