R-78-31 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING PRELIMINARY PLAT <br />OF DEMONTREVILLE HIGHLANDS 5TH ADDITION <br />WHEREAS, Derrick Land Co. of 1770 Shelard Towers, St. Louis <br />Park, Minnesota 55426, has filed an application with the City <br />for approval of the preliminary plat of DEMONTREVILLE HIGHLANDS <br />5TH ADDITION, a copy of which preliminary plat is on file with <br />the City clerk; and <br />WHEREAS, the proposed plan, has been reviewed by -the City <br />staff and considered at public hearing by the City Planning <br />Commission all as required by City ordinances; and <br />WHEREAS, the City Council has also considered the proposed <br />preliminary plat together with the recommendations of the <br />Planning Commission thereon and the recommendations of the City <br />staff; and <br />WHEREAS, the City Council has determined: that said <br />preliminary plat is consistent with the intent and purpose of <br />the City's Comprehensive Plan, zoning ordinance, subdivision <br />ordinance, and other applicable regulations - provided the <br />conditions of approval set forth below are incorporated into <br />said plan: <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the <br />City of Lake Elmo that the preliminary plat of DEMONTREVILLE <br />HIGHLANDS 5TH ADDITION, on file with the City Clerk, is hereby <br />approved subject to the following conditions: <br />1. The developer shall enter into a Development Agreement <br />with the City of Lake Elmo providing for completion of <br />all improvements required by the City's subdivision <br />ordinance and the plans herein approved. <br />2. The said Development Agreement shall be secured by bond, <br />cash deposit, or letter of credit approved by the City <br />
