R-78-30 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING THE PLAT OF SPRINGBORN <br />GREEN ACRES. <br />WHEREAS, the City Council of the City of Lake Elmo has <br />previously considered and approved the preliminary plat of <br />SPRINGBORN GREEN ACRES; and <br />WHEREAS, the applicant has now presented to the City a final <br />plat which conforms to the approved preliminary plat and meets <br />with the requirements of the City subdivision ordinance: <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council does <br />hereby approve and accept the final plat of SPRINGBORN GREEN <br />ACRES, as is on file with the City Clerk, subject to the following <br />conditions: <br />1. The developer shall file with the City a Certificate of <br />Survey prepared by a registered land surveyor describing <br />and certifying the location of the boundaries of 55th <br />Street North as that street is laid out and dedicated <br />between the plat of SPRINGBORN GREEN ACRES and the <br />existing public road known as DeMontreville Trail North. <br />A Deed or other instrument of conveyance approved by <br />the City Attorney dedicating the land so described as <br />55th Street North shall be delivered to the City in <br />proper form for recording. <br />2. The applicant shall enter into a Development Agreement <br />as required by the City subdivision ordinance, providing <br />for the construction of all streets and related improve- <br />ments to City standards. The developers performance of <br />said Development Agreement shall be secured by security <br />bond, cash deposit, or letter of credit in a form approved <br />by the City Attorney, or such other security as may be <br />hereafter approved by'the City Council. The amount of <br />said bond shall. be determined by the City Engineer in <br />accordance with the provisions of the subdivision ordinance. <br />Adopted by the City Council this 5th day of September, 1978. <br />Thomas G.
