MINUTES, LARE ELMO CITY COUNCIL, January 2, 1979. Pg. 2 <br />MINUTES: Morgan moved, seconded by Armstrong, to approve the minutes <br />of the, December 19, 1978, City Council meeting. Motion <br />carried 3-0--2, with Councillors Johnson and Mottaz <br />abstaining, as they .were not in office at the time of <br />this meeting. <br />FRED BANISTER MINOR SUBDIVISION: Mayor Armstrong read the recommendation <br />of the Planning Commission; and the Council discussed <br />alternative ways of..meeting the P7.0 conditions. Armstrong <br />moved, seconded by Pott, that plan for subdivision of. the <br />Banister property dated January 2, 1979, with the follow- <br />ing Variances; no public access to Lot 1, acceptance of <br />the existing setback'£or the building on Lot 2, Lot 3 is <br />slightly under one acre; subject to the owners entering <br />into an agreement to maintain a perpetual easement for <br />driveway access, to be recorded against all the property <br />involved in the use of the'dr.:iveway access and covering <br />maintenance and improvement of the said access; and <br />subject to the owners providing a Certificate of Survey <br />to the City and the County Surveyor. Said agreement to <br />be approved by the City Attorney. Motion Carried 5-0, <br />PETER SCHILTGEN/REID FARM DRAINAGE EASEMENT: Peter Schiltgen appeared <br />before the Council representing Mrs. Reid, owner and him- <br />self, tenant, of the property just east of Lake Elmo <br />Ilardwood Lumber, to discuss alternative ways to main- <br />taining the drainage -way through.that: property. After <br />some discussion, Mr. Schiltgen agreed to plow a dead <br />furrow along the present drainage way to maintain the <br />channel; and improve the channel along the west edge of <br />the property so that water can get to the drainage -way; <br />and the Council agreed to stop proceedings to acquire <br />a formal drainage easement to preserve this natural <br />drainage -way. The Council also instructed the Building <br />Inspector to inspect debris deposited on the Reid property <br />by Lake Elmo Hardwoad Lumber; at Mr. Schiltgen's request. <br />The Mayor and City Attorney were asked to check into a <br />possible guardianship for Mrs. Reid. <br />ANNUAL APPOINTMENTS: <br />Morgan moved, seconded by Johnson, to name the State <br />Ba - re Elmer.. W—ash—ngtov�ederal as official <br />depositories. Motion carried 5-0. <br />Mottaz moved, seconded by Morgan, to name the Stillwater <br />Daily Gazette as official newspaper. Potion carried 5-0. <br />Armstrong moved, seconded by Pott, to reappoint. Earl <br />Cberss the Energy Coordinator.. Motion carried 5-0. <br />Armstrong moved, seconded by Pott, to appoint. Robert <br />Dreher, Howard;Michels and Nancy Prince to thneee year <br />terms on the Planning Commission. Motion carried 5-0. <br />The Council instructed the Adminstrator to set up inter- <br />views for an alternate member of the PAC. <br />
