R-79- � 3 G <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ACCEPTING STREET IMPROVEMENTS ONLY IN THE <br />PLAT OF FOX FIRE ESTATES. <br />WHEREAS, the developers of Fox Fire Estates Addition <br />subdivision have substantially completed the bituminous surfacing <br />of the street improvements required under the Development <br />Agreement between the City and said developers dated <br />October 27, 1978; and <br />WHEREAS, said street improvements have been inspected <br />by the City Engineer and said Engineer, by his letter of <br />November 20, 1979, has recommended acceptance of the street <br />improvements only, for winter maintenance, so as to allow <br />the developer to complete any remaining corrective work in the <br />Spring of 1980: <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of <br />the City of Lake Elmo as follows: <br />1. The street improvements constructed by the developer <br />of the plat of Fox Fire Estates Addition be, and the same <br />hereby are, accepted by the City Council for winter maintenance, <br />subject to the right of the City to require the developer to <br />perform any remaining corrective work which may appear to be <br />necessary to the City Engineer in the Spring of 1980 and subject, <br />also, to the one year warranty provided in the Development <br />Agreement. <br />2. The developers' bond or other security deposit is <br />hereby ordered reduced to the sum of $5,000.00 which the City <br />Council, based on the recommendation of the Engineer, deemed <br />sufficient to ensure completion of any remaining corrective work <br />which may be necessary. <br />Adopted b the City Council of the City of Lake Elmo this <br />E` b day of UZ , 1979. <br />Thomas G.
