R-79- 53 Q, <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ACCEPTING STREET IMPROVEMENTS ONLY FOR <br />WINTER MAINTENANCE IN THE PLAT OF SPRINGBORNS GREEN ACRES. <br />WHEREAS, the developers of Springborns Green Acres <br />Subdivision have substantially completed construction of the <br />street surfacing improvements required under the Development <br />Agreement entered into between the City and said developers <br />dated January 8, 1979; and <br />WHEREAS, said improvements have been inspected by the <br />City Engineer and said Engineer, by his letter of November 20, <br />1979, has recommended acceptance of the street improvements <br />only, for winter maintenance, subject to any necessary corrective <br />work which may be required in the Spring of 1980: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Lake Elmo as follows: <br />1. The street surfacing improvements constructed by <br />the developer in the'plat of Springborns Green Acres be, and <br />the same hereby are, accepted by the City Council for winter <br />maintenance subject to the right of the City to require the <br />developer to perform any necessary corrective work which <br />may appear to be necessary to the City Engineer in the Spring <br />of 1980 and subject, also, to the one year warranty provided in <br />the Development Agreement. <br />2. The developers' bond or other security deposit is <br />hereby ordered reduced to the sum of $5,000.00 which the City <br />Council, based on the recommendation of the Engineer, deemed <br />sufficient to ensure completion of any necessary corrective <br />work. <br />AdoptedX the C�1ity Council of the City of Lake Elmo this <br />o c)) day of (I� IVYYt,C - , 19-79. <br />�- <br />Thomas G.
